1 <br /> ESOLUTDON NO. 17-917 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON APPROVING A GROWTH 1IANAGEMENT AGREEMENT <br /> ( P 1 5-0 4 0 6 ) WITH IRBY RANCH LLC FOR THE CONSTRUCTION OF <br /> EIGHTY-SEVEN (87) SINGLE-FA>>iILY HO('DES AND RELATED SITE <br /> I o n PROVEi,/ ENTS AT 3988 FIRST STREET, 3878 STANLEY BOULEVARD, <br /> AND 3780 STANLEY BOULEVARD,AS FLED UNDER CASE NO. PUD-110 <br /> i4.HEREAS, the City has approved PUD-110 by Irby Ranch LLC for the <br /> construction of eighty-seven (87) new single-family homes (the "Project'); and <br /> \ ,°HEREAS , Ordinance 2112 of the City of Pleasanton sets forth a Growth <br /> Management Program (at Chapter 17 36 of the Pleasanton Municipal Code) which <br /> authorizes the City to enter into agreements with developers to achieve orderly growth <br /> rates for residential development; and <br /> WHEREAS, Ordinance 2112 states that for the current Regional Housing <br /> Needs Allocations (RHNA) cycle (5th Cycle from January 1, 2014 — October 31, <br /> 2022), the annual Growth Management unit allocation shall not exceed the number <br /> of units required to meet the City's RHNA for the fifth cycle divided by the number <br /> of years in that cycle,and <br /> 'HERE'S, the Project's units would be used to meet the RHNA for the <br /> fifth cycle;and <br /> ,i`,HEREAS, a duly noticed hearing concerning the Growth Management <br /> Agreement was held by the City Council on February 7, 2017; and <br /> ',,/HEREAS, the City Council determined that the conditions described in California <br /> Environmental Quality Act (CEQA) Guidelines Section 15162 have not occurred for the <br /> proposed Project and found that the previously prepared Supplemental Environmental <br /> Impact Report (SEIR), including the adopted CEQA Findings and Statement of Overriding <br /> Considerations in City Council Resolution 12-492 for the Housing Element update and <br /> Climate Action Plan Amendment and Rezoning's, and the Addendum to the SEIR are <br /> adequate to serve as the environmental documentation for this Project and satisfy all the <br /> requirements of CEQA, and <br /> \F'!HEREAS,the City Council finds that it is in the best interest of the City to <br /> enter into a Growth Management Agreement for PUD-110. <br /> NOW, THEREFORE, BE IT RESOLVED THAT T1 E CITY COUNCIL OF <br /> THE CITY OF PLEASANTON DOES RESOLVE,DECLARE, DETERMINE, AN) <br /> ORDER THE FOLLOWING: <br /> SECTION 1. Approves the Growth Management Agreement with Irby Ranch LLC, <br /> for PUD-110 in substantially the form as the agreement attached hereto as Exhibit A, <br /> subject to minor amendments approved by the City manager and City Attorney, which is <br /> incorporated herein by this reference, and authorizes the City Manager to sign the <br /> agreement when approved as to final form by the City Attorney <br /> 1 <br />
