<br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING
<br /> THE FRAME 'YORK AGREE' SENT BETWEEN THE CITY OF PLEASANTON, IRBY RANCH
<br /> LLC, AND SUNFLOWER HILL
<br /> WHEREAS, Irby Ranch, LLC, has applied to the City for a General Plan Amendment,
<br /> Specific Plan Amendment, Rezoning, Planned Unit Development (PUD) Development Plan,
<br /> Vesting Tentative Map, Development Agreement, Affordable Housing Agreement, and Growth
<br /> Management Agreement filed under Case Nos. PUD-110, P15-0245, P15-0246, P15-0405, and
<br /> Vesting Tentative Map 8245 (the "Project"); and
<br /> WHEREAS, the Project includes a 1 64 acre parcel for a potential future development by
<br /> Sunflower Hill, a California public benefit corporation; and
<br /> WHEREAS, on February 7, 2017, a duly-noticed public hearing was held by the City Council
<br /> on the Project, the Affordable Housing Agreement with Irby Ranch, an Exclusive Negotiating
<br /> Rights Agreement with Sunflower Hill, as well as the Framework agreement, and the Council
<br /> considered all public testimony, agenda reports, and related materials, and the recommendations
<br /> of staff, the Housing and Planning Commissions, and
<br /> WHEREAS, the City Council determined that the conditions described in California
<br /> Environmental Quality Act (CEQA) Guidelines Section 15162 have not occurred for the proposed
<br /> Project and found that the previously prepared Supplemental Environmental Impact Report
<br /> (SEIR), including the adopted CEQA Findings and Statement of Overriding Considerations in City I
<br /> Council Resolution 12-492, for the Housing Element update and Climate Action Plan Amendment
<br /> and Rezonings, and the Addendum to the SEIR are adequate to serve as the environmental
<br /> documentation for this Project and satisfy all the requirements of CEQA; and
<br /> WHEREAS, the City Council considered all information presented at the public hearing
<br /> regarding the terms of the Framework agreement
<br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF
<br /> PLEASANTON DOES RESOLVE, DECLARE, DETERHINE, AND ORDER THE FOLLOWING:
<br /> SECTION 1 Finds that the proposed Framework agreement between the City of
<br /> Pleasanton, Irby Ranch LLC, and Sunflower Hill is consistent with the City's General Plan and the
<br /> objectives of the City's affordable housing policies.
<br /> SECTION 2. Approves the Framework agreement between the City of Pleasanton, Irby
<br /> Ranch LLC, and Sunflower Hill, a copy of which is attached hereto as Exhibit A and incorporated
<br /> herein by this reference, and authorizes the City Manager to sign the Framework agreement in
<br /> generally the form as shown in the attached Exhibit A, subject to minor modifications approved by
<br /> the City Manager and City Attorney
<br /> SECTION 3. This resolution shall become effective immediately upon the effective date
<br /> of the ordinances approving PUD-110 and related development agreement
