RECOMMENDATION <br /> 1 Find that the proposed amendment to the Municipal Code is exempt from the <br /> California Environmental Quality Act (CEQA), <br /> 2 Introduce the draft ordinance, find the subject code amendment consistent with the <br /> General Plan, and approve Case P16-1418, amendment to the Pleasanton Municipal <br /> Code as shown in Attachment 1, and <br /> 3 Adopt a resolution to amend the Master Fee Schedule to add a Minor Conditional Use <br /> Permit fee (Attachment 2) <br /> FINANCIAL STATEMENT <br /> No fiscal impact to the City or public services is anticipated with this Municipal Code <br /> Update The City would receive application fees as a result of the proposed Minor <br /> Conditional Use Permit <br /> BACKGROUND <br /> 1 The proposed update to the Zoning Code (Title 18 of the Municipal Code) is intended <br /> primarily to (1) simplify and update the list of permitted and conditionally permitted land <br /> uses, (2) establish a Minor Conditional Use Permit process that would allow staff to <br /> administer discretion over uses that are more routine in nature but still require an <br /> evaluation and mitigation of potential impacts, such as those related to parking, noise, <br /> odor, and land use compatibility, and (3) undertake other changes to reflect current <br /> practice/law and increase the usability of the document A key objective is to make the <br /> regulations in the Zoning Code easier for members of the community to interpret and use <br /> Staff has conducted an extensive outreach effort related to the code amendment, and <br /> has presented the code update and solicited feedback from the Economic Vitality <br /> Committee, the Economic Development & Government Relations Committee of the <br /> Chamber of Commerce, the Downtown Vitality Committee and Board of Directors of the <br /> Pleasanton Downtown Association, and Planning Commission (during a Work Session on <br /> August 31, 2016) Staff also held a Stakeholder Meeting with interested parties on <br /> November 9, 2016 and has met one-on-one with interested members of the public on an <br /> as-requested basis In total, staff has held six stakeholder meetings on the code <br /> amendment The proposed amendment to the code has generally received a favorable <br /> review by these entities, and thus staff is bringing the code amendments forward to the <br /> City Council for its consideration <br /> The attached Planning Commission staff report, dated December 14, 2016 (Attachment <br />'i 3), provides additional background information The changes that have been made as a <br /> result of public comment prior to the December 14, 2016 Planning Commission hearing <br /> are identified in Attachment 3, Exhibit B, and are organized into two categories Table 1 <br /> identifies the comments that have been implemented (including a description of how the <br /> comments have been implemented) and Table 2 identifies the comments that are <br /> suggested for future updates or that have not been implemented Generally, staff <br /> incorporated comments that were consistent with the overall objectives of this initial <br /> phase of the Zoning Code update and those that resulted in clarifications to existing or <br /> new definitions or sections of the code Comments that were not implemented or <br /> Page 2 of 9 <br />
