3 <br /> THE CITY OF <br /> yo"` CITY COUNCIL AGENDA REPORT <br /> pLEASANTON® <br /> January 17, 2017 <br /> Community Development Department <br /> Planning Division <br /> TITLE: APPROVE THIRD AMENDMENT TO THE PROFESSIONAL SERVICES <br /> AGREEMENT WITH AECOM FOR SERVICES NOT TO EXCEED $39,911 <br /> FOR ASSISTANCE PREPARING ALTERNATIVES TO THE DRAINAGE <br /> SWALE CULVERT PROJECT AS PART OF THE LIONS WAYSIDE AND <br /> DELUCCHI PARKS MASTER PLAN <br /> SUMMARY <br /> At its June 3, 2014 meeting, the City Council approved the award of a Professional <br /> Services Agreement (Agreement) with AECOM for the completion of environmental <br /> documentation and the permitting application for improvements associated with the Lions <br /> Wayside and Delucchi Parks Master Plan (Master Plan) A key component of this work <br /> entailed preparing and submitting environmental permit applications for culverting a <br /> section of a drainage swale that extends through Lions Wayside Park In October 2015 <br /> permit applications were submitted to the regional, state and federal natural resources <br /> agencies with jurisdiction over the drainage swale After receiving letters from these <br /> agencies expressing serious concerns with the culvert project, City staff met with agency <br /> representatives at Lions Wayside Park in April 2016 After agency representatives again <br /> expressed concern and opposition to the culverting project as currently proposed, City <br /> staff determined the most feasible path forward to secure the necessary permits would be <br /> to develop new culvert alternatives to reduce the length of undergrounded drainage <br /> swale while still meeting the key design objectives of the Master Plan Subsequently, City <br /> staff requested that AECOM prepare a proposal for this additional work which would <br /> comprise the Third Amendment to the contract with AECOM The First and Second <br /> Amendments simply extended the term of the contract and did not involve a budget <br /> amendment Staff is requesting approval of this Third Amendment, which would increase <br /> the total Agreement amount by $39,911 from $144,510 to $184,421 <br /> RECOMMENDATION <br /> 1 Approve the Third Amendment to the Professional Services Agreement with AECOM <br /> in the amount not to exceed $39,911 <br /> 2 Authorize the City Manager to enter into the above-noted Third Amendment to the <br /> Agreement with AECOM <br /> FINANCIAL STATEMENT <br /> There are sufficient funds in Capital Improvement Program (CIP) Project #067016 to <br /> cover the $39,911 of the Third Amendment <br />
