CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 803 <br /> <br /> AN ORDINANCE APPROVING THE ANNEXATION OF <br /> CERTAIN UNINHABITED TERRITORY DESIGNATED <br /> "PLEASANTON ANNEXATION NO. 71" TO THE <br /> CITY OF PLEASANTON (OLD SANTA RITA ROAD) <br /> <br /> WHEREAS, on November 8, 1976, the City Council passed <br />and adopted Resolution No. 76-243 giving notice of the proposed <br />annexation of certain uninhabited territory to the City of <br />Pleasanton, said territory being therein designated as "Pleasanton <br />Annexation No. 71", said resolution describing the boundaries of <br />the territory proposed to be annexed; and <br /> <br /> WHEREAS, said resolution did contain a notice of the day, <br />hour and place when and where the City Council would hear pro- <br />tests made by any person owning real property within the territory <br />proposed to be annexed, the time of said hearing being not less <br />than 40 nor more than 60 days from the date of passage of said <br />resolution; and <br /> <br /> WHEREAS, on January 3, 1977, at the hour of 8:00 P.M. in <br />the Council Chambers of the City of Pleasanton, 30 West Angela <br />Street, County of Alameda, State of California,said time and place <br />being the day, hour and place fixed in said resolution for hearing <br />protests to the said annexation, the City Council did hear and <br />pass upon all protests made to the proposed annexation and did de- <br />termine that protests had not been made by owners of one-half of <br />the value of the privately owned territory proposed to be annexed <br />as shown by the last equalized assessment roll, nor by public <br />owners of one-half of the value of the publicly owned territory <br />proposed to be annexed as determined by said legislative body; <br />and <br /> <br /> WHEREAS, said territory is contiguous to the City of <br />Pleasanton, and is uninhabited territory in the County of Alameda; <br />and <br /> <br /> WHEREAS, owners of more than two-thirds of the value of <br />the territory proposed to be annexed have filed with the City <br />Clerk pursuant to Section 35319 of the Government Code of the <br />State of California, their written consent to have said territory <br />taxed to pay any indebtedness or liability of the City contracted <br />prior to or existing at the time of annexation, to wit, to pay <br />their proportionate share of the bonded indebtedness of the City <br />of Pleasanton presently authorized for the acquisition, construc- <br />tion or completion of municipal improvements. <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASAN- <br />TON DOES HEREBY ORDAIN AS FOLLOWS: <br /> <br /> Section 1. The City Council does hereby approve the an- <br />nexation of the territory hereinafter described in Exhibit A, <br /> <br /> <br />
