EBMUD
has indicated a willingness to share its available capacity m the expanded treatment plant with
Pleasanton until EBMUD needs it EBMUD has historically shared its capacity with DSRSD as
its DERWA partner, and as long as Pleasanton's involvement with DERWA continues to move
toward a higher level of partnership,EBMUD would make capacity available This shared filter
capacity is expected to provide sufficient capacity for Pleasanton's recycled water demands to
2020 or later.
To confirm Pleasanton's participation in this expansion, Pleasanton must sign the attached notice
to proceed and pay a proportional share of planning, design, and construction costs. As per
Section 5.3 (c)of the Agreement,Pleasanton shall make payment to DERWA in three
installments, one third at the time Pleasanton provides notice to DERWA to proceed, one third at
the time of award of the construction contract, and one third at the time of 50%completion of
construction At the time of this letter, the total cost of the Phase 2 Project is estimated at
$18,200,000. Pleasanton's estimated share is $4,868,425 with the first two payments equal to
$3,245,616 due when the notice to proceed is signed and returned by Pleasanton and when the
construction contract is awarded The final payment of$1,622,809 will be due at 50%
completion of construction
The attached invoice requests the following payments for the DERWA Phase 2 Project-
Description Amount Payee
First installment for DERWA Phase 2 Project $1,622,808 DERWA
Second installment for DERWA Phase 2 Project $1,622,808 DERWA
If you have any questions regarding these payments or need additional information please
contact me at 510-287-0125 or michael tognoluii @ebmud corn
Sincerely,
' f
Michael T Tognoluu
Authority Manager
Attachments
W\wsid\Mgmt\DERWA120161DERWA Phase 2 ltr to Pleasanton December 2016 docx
