NOW, THEREFORE, in consideration of these Recitals and the terms, conditions and covenants <br /> contained herein, it is mutually understood and agreed as follows <br /> SECTION 1: TEMPORARY WATER SUPPLY TURNOUT <br /> 1.1. The potable water point of delivery to the recycled water system will be located at the <br /> existing tee connection on the Pleasanton 16-inch water line located on the north boundary of the <br /> Regional Wastewater Treatment Plant <br /> 1.2. DERWA shall be responsible for planning, design, construction, operation and maintenance <br /> of all facilities downstream of the point of delivery including a billing meter in accordance with <br /> Pleasanton metenng requirements Control of flow through the turnout shall be through a flow <br /> control valve Real time water flow data shall be transmitted to the Pleasanton SCADA <br /> monitonng system Introduction of potable water to the recycled water system shall meet public <br /> health requirements for backflow prevention Design and construction of the turnout, including <br /> but not limited to the billing meter, flow control valve, and backflow prevention device, shall be <br /> approved by Pleasanton before being put into use <br /> 1.3. The billing meter, once installed by DERWA and accepted by Pleasanton, shall be owned <br /> by Pleasanton Pleasanton shall bill DERWA for the quantities of potable water utilized <br /> DERWA shall be responsible for the costs of maintaining the billing meter <br /> 1.4. Pleasanton shall be responsible for a proportional share of the cost of installing the <br /> temporary water supply turnout in accordance with its share of the capital budget for the Phase 2 <br /> Project. <br /> 1.5. This temporary water supply turnout will be valved off once the Phase 2 Project <br /> construction and operational startup has been completed (expected in 2018) <br /> SECTION 2: NOTIFICATION OF TEMPORARY WA'T'ER SUPPLY USE <br /> 2.1 DERWA may operate the turnout to meet the daily irrigation demands as needed during <br /> construction of the Phase 2 Project to ensure DERWA's ability to meet daily recycled water <br /> demands, The Phase 2 Project construction is currently anticipated to occur from December <br /> 2016 to February 2018,but the schedule will be updated as the construction progresses <br /> 2.2 The DSRSD Operations Manager, in coordination with DERWA, shall, as soon as <br /> practicable, notify the Pleasanton Operations Services Department by phone any time the turnout <br /> is placed into operation Said notification should include a descnption of the need for supply, the <br /> estimated rate of supply, and the estimated duration <br /> 2.3 The DSRSD Operations Manager, in coordination with DERWA, shall, as soon as <br /> practicable, notify the Pleasanton Operations Services Department of any significant changes to <br /> the estimated rate and duration of use and provide notification when use of the turnout is <br /> terminated <br /> 2 <br />
