CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 798 <br /> <br /> AN ORDINANCE AMENDING ~2-15.13, ARTICLE 2 (SEWER CONNEC- <br /> TION FEES), CHAPTER 8 (SEWAGE) AND ~2-16.21, ARTICLE 2 <br /> (WATER CONNECTION FEES), CHAPTER 9 (WATER) OF TITLE II <br /> (ZONING AND DEVELOPMENT) OF THE ORDINANCE CODE OF THE <br /> CITY OF PLEASANTON RELATING TO EXEMPTIONS TO CHARGES <br /> FOR CASUALTY LOSSES. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES ORDAIN AS FOLLOWS: <br /> <br />Section 1. Subsection f., ~2-15.13 (Connection Charges), Article <br /> Chapter 8, Title II of the Ordinance Code of the City of <br /> Pleasanton is amended to read as follows: <br /> <br /> f. Upon application and good cause shown, the City <br /> Council may in its sole discretion waive any of <br /> the charges provided for in the resolution es- <br /> tablishing fees and charges for various municipal <br /> services for the City of Pleasanton. <br /> <br /> However, no sewer connection charge shall he re- <br /> quired for the reconstruction, rehabilitation, or <br /> repair to an existing structure damaged or des- <br /> troyed by a natural catastrophy or Act of God, in- <br /> cluding but not limited to, fires, earthquakes, <br /> and floods. The owner of a dwelling or business <br /> so affected shall not enlarge the premises beyond <br /> its previous sewage requirements without paying <br /> the increased sewer connection fee. <br /> <br />Section 2. Section 2-16.21 (Connection Charges), Article 2, <br /> Chapter 9, Title II of the Ordinance Code of the City of <br /> Pleasanton is amended to read as follows: <br /> <br /> ~2-16.21 Connection Charges. To establish appropri- <br /> ate provisions for the construction and expansion <br /> of the water system of the City, including trans- <br /> mission mains, storage and pumping facilities, <br /> and to be assured that the cost of such construc- <br /> tion and expansion is borne by those who receive <br /> the benefits thereof, there is hereby established <br /> connection charges for all connections made to <br /> the water system of the City after the effective <br /> date of Ordinance No. 466, September 9, 1966. <br /> <br /> The amount of the connection charge shall be in <br /> accordance with the amount specified in the Reso- <br /> lution Establishing Various Fees and Charges for <br /> Municipal Services of the City of Pleasanton. <br /> <br /> Water connection charges shall be paid for all <br /> new construction connected to the water system <br /> except for new construction required for the re- <br /> construction, rehabilitation, or repair to an <br /> existing structure damaged or destroyed by a <br /> natural castastrophe or Act of God, including but <br /> not limited to fires, earthquakes, and floods. <br /> The owner of a dwelling or business so affected <br /> shall not enlarge the premises beyond its pre- <br /> vious water requirements without paying the in- <br /> creased water connection fee. <br /> <br /> <br />
