URGENCY ORDINANCE NO. 2152 <br /> AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON AMENDING PLEASANTON MUNICIPAL CODE CHAPTER 6.18 <br /> TO PROHIBIT COMMERCIAL NONMEDICAL MARIJUANA AND HEMP <br /> ACTIVITIES, AND ALLOW INDOOR GROWING OF UP TO SIX MARIJUANA <br /> PLANTS PER RESIDENCE, IF THE ADULT USE OF MARIJUANA ACT <br /> (PROPOSITION 64) IS APPROVED BY CALIFORNIA VOTERS <br /> WHEREAS, due to concerns about robberies of medical marijuana dispensaries <br /> and dispensary staff, use of medical marijuana by non-qualified persons — particularly <br /> diversion to minors, and home invasions by people seeking cash or marijuana, the City <br /> prohibits commercial medical marijuana activity as provided in Municipal Code Chapter <br /> 6 18, while recognizing qualified patients' need for medical marijuana and services <br /> provided by qualified caregivers, and <br /> WHEREAS, the Control, Regulate and Tax Adult Use of Marijuana Act (the "Adult <br /> Use of Marijuana Act", "AUMA", "Proposition 64") is an initiative to legalize adult <br /> recreational use of, and allow commercial activities related to, marijuana and hemp, which <br /> will be considered by California voters at the November 8, 2016 general election If <br /> adopted, some provisions of the AUMA will go into effect November 9, 2016, and <br /> WHEREAS, an urgency ordinance is needed to address the public health and <br /> safety concerns of Pleasanton residents, visitors and businesses from the negative <br /> effects from increased crime and use of marijuana by minors which may occur if the <br /> AUMA is adopted on November 8, 2016 <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOES HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1 If the Control, Regulate and Tax Adult Use of Marijuana Act (the <br /> "Adult Use of Marijuana Act", "AUMA", "Proposition 64") is approved by California <br /> voters on November 8, 2016, Pleasanton Municipal Code Chapter 6 18 is amended as <br /> follows <br />
