RESOLUTION NO. 16-892 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DEDICATING A PUBLIC UTILITY EASEMENT TO THE PUBLIC UTILITIES ON THE <br /> KOTTINGER GARDENS PROPERTY LOCATED AT 240 KOTTINGER DRIVE <br /> WHEREAS, on June 3, 2014, the City Council approved Case PUD 101, an application <br /> by MidPen Housing Corporation (MidPen) for a Planned Unit Development plan called Kottinger <br /> Gardens to construct 185 senior homes and related site improvements located at 240 and 251 <br /> Kottinger Drive; and <br /> WHEREAS, the City of Pleasanton is the property owner of 240 and 251 Kottinger Drive; <br /> and <br /> WHEREAS, Kottinger Gardens will be constructed in two phases: Phase 1 will replace <br /> the existing 50 senior homes of Kottinger Place, 240 Kottinger Drive, with 131 senior homes and <br /> Phase 2 will replace the existing 40 senior homes of Pleasanton Gardens, 251 Kottinger Drive, <br /> with 54 senior homes; and <br /> WHEREAS, Phase 1, includes the demolition of all existing buildings and almost all of the <br /> utilities at Kottinger Place at 240 Kottinger Drive; and <br /> WHEREAS,the City Council finds that a public utility easement of varying width dedicated <br /> to the Public Utilities provides for the access needed for the Public Utilities to install, operate, <br /> maintain and repair their new on-site facilities to serve the new buildings as part of Phase 1. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: <br /> SECTION 1. The City Council finds that the Public Utilities need access to install, operate, <br /> maintain, and repair their new on-site facilities to serve the new buildings as part of Kottinger <br /> Gardens, Phase 1, located at 240 Kottinger Drive. <br /> SECTION 2. The City will dedicate a public utility easement of varying width to the Public <br /> Utilities on the Kottinger Gardens property located at 240 Kottinger Drive. <br /> SECTION 3. The City Manager is authorized to execute the declaration of public utility <br /> easement and the City Clerk is directed to cause such document to be recorded in the Alameda <br /> County Records. <br /> PASSED, APPROVED, AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on October 4, 2016. <br />
