ORDINANCE NO. 2150 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE APPLICATION OF MIKE AND THERESA CAREY FOR A <br /> CERTIFICATE OF APPROPIATENENSS AND PLANNED UNIT DEVELOPMENT <br /> (PUD) REZONING AND DEVELOPMENT PLAN APPROVAL, AS FILED UNDER <br /> CASE PUD-118 <br /> WHEREAS, Mike and Theresa Carey applied for: 1) a certificate of appropriateness to <br /> demolish all existing structures; 2) rezoning of an approximately 13,040-square-foot site from 0 <br /> (Office) to Planned Unit Development — Mixed-Use (PUD-MU); and 3) PUD Development Plan <br /> approval to construct: a) an approximately 2,229-square-foot, three-story mixed-use building <br /> with office/retail space on the first-floor and three apartments on the second- and third-floors; <br /> and b) three, three-story, detached single-family homes, with office space on the first-floor of <br /> Residence 1, and related site improvements located at 4791 Augustine Street (the "Project"); <br /> and <br /> WHEREAS, after a May 25, 2016 workshop, at its meeting of July 13, 2016, with a 3-1 <br /> vote, the Planning Commission determined that the certificate of appropriateness, rezoning and <br /> development plan are appropriate for the site, made the findings, and recommended to the <br /> Pleasanton City Council that PUD-118 be approved; and <br /> WHEREAS, on September 6, 2016, the Pleasanton City Council held a duly noticed <br /> public hearing on this application and considered all public testimony, agenda reports, and <br /> related materials, and the recommendations of City staff and the Planning Commission; and <br /> WHEREAS, after a review of the materials presented, the Pleasanton City Council <br /> determines that the certificate of appropriateness and proposed PUD rezoning and development <br /> plan are consistent with the City's General Plan, Downtown Specific Plan, and purposes of the <br /> PUD ordinance, and by this reference adopts and reaffirms all of the considerations and findings <br /> set forth in Planning Commission resolution. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY <br /> ORDAIN AS FOLLOWS: <br /> SECTION 1. Approves the rezoning of 4791 Augustine Street from 0 (Office) District to <br /> the PUD-MU (Planned Unit Development— Mixed-Use) District. <br /> SECTION 2. The Zoning Map of the City of Pleasanton, on file with the City Clerk, <br /> designating and dividing the City into zoning districts, is hereby amended to Zoning Unit Map <br /> No. 498 attached hereto as Exhibit B, dated September 20, 2016, and incorporated herein by <br /> this reference. <br /> SECTION 3. The City Council approves Case PUD-118, the application of Mike and <br /> Theresa Carey for: 1) a certificate of appropriateness to demolish all existing structures; 2) PUD <br /> Development Plan approval to construct: a) an approximately 2,229-square-foot, three-story <br /> mixed-use building with office/retail space on the first-floor and three apartments on the second- <br /> and third-floors; and b) three, three-story, detached single-family homes, with office space on <br /> the first-floor of Residence 1, and related site improvements located at 4791 Augustine Street, <br /> subject to the conditions as shown in Exhibit A, attached hereto and made part of this ordinance <br /> by this reference. <br />
