RESOLUTION NO. 16-887 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON DENYING <br /> THE APPEAL OF JEFF RENHOLTS OF THE PLEASANTON MASONIC CENTER, <br /> THEREBY UPHOLDING THE PLANNING COMMISSION'S DECISION TO MODIFY <br /> THE EXISTING CONDITIONAL USE PERMIT (UP-77-13) WITH MODIFIED <br /> CONDITIONS OF APPROVAL <br /> WHEREAS, the City of Pleasanton initiated the review and consideration of possible <br /> retention without modification to, modification to, or revocation of, an approved Conditional Use <br /> Permit for Pleasanton Masonic Center at 3370 Hopyard Road; and <br /> WHEREAS, zoning for the property at 3370 Hopyard Road is RM-2,500 (Multi-Family <br /> Residential) District; and <br /> WHEREAS, modifications to existing use permits are categorically exempt from the <br /> requirements of the California Environmental Quality Act (CEQA); and <br /> WHEREAS, at its duly noticed public hearing of June 22, 2016, the Planning <br /> Commission considered all public testimony, relevant exhibits, and recommendations of the City <br /> staff concerning this application; and <br /> WHEREAS, at its meeting of June 22, 2016, the Planning Commission, after having <br /> considered all public testimony, relevant exhibits, and recommendations of City staff concerning <br /> this matter, made the necessary findings to modify the existing conditional use permit <br /> and determined that a modified conditional use permit would be compatible with the <br /> existing uses in the area; and <br /> WHEREAS, at its meeting of June 22, 2016, the Planning Commission approved <br /> modifications to the existing conditional use permit by amending the conditions of approval for <br /> UP-77-13; and <br /> WHEREAS, within the time specified by the Pleasanton Municipal Code, Jeff Renholts <br /> of the Pleasanton Masonic Center, submitted an appeal of the decision of the Planning <br /> Commission; and <br /> WHEREAS, at its meeting of September 20, 2016, the City Council received a report <br /> from the Director of Community Development, together with a copy of the June 22, 2016 staff <br /> report to the Planning Commission, regarding this matter; and <br /> WHEREAS, the City Council held a noticed public hearing on September 20, 2016, at <br /> which time the appellant and members of the public were offered an opportunity to present <br /> evidence regarding this appeal; and <br /> WHEREAS, after testimony at the public hearing and a review of the materials <br /> presented, the City Council determined that a modified conditional use permit is appropriate for <br /> the site and is consistent with the zoning regulations for the zoning district of the property. <br /> WHEREAS, the City Council further modified the conditions approved by the Planning <br /> Commission. <br /> 1 <br />
