Under the Pleasanton Municipal Code, revocation of a Conditional Use <br />Permit would preclude a future application for the same or substantially the same <br />conditional use on the site for a period of 1 year. Staff did not recommend this option <br />because it believed that with implementation of appropriate conditions or approval, the <br />Millers concerns could be mitigated. <br />Option No. 3: Modify UP -77 -13 Approval <br />Option 3 reflected a scenario whereby the Masonic Center could be operated in a manner <br />that is compatible with its surroundings. Under this option, new conditions would be <br />crafted to address the Millers' concerns and clarify the specific operational parameters of <br />the Masonic Center and ancillary uses. <br />The Commission approved Option 3 and modified the Conditional Use Permit. These <br />modifications are summarized below; items marked with an asterisk ( *) represent staff - <br />recommended conditions made more restrictive by the Planning Commission (please see <br />Attachment 4 for the original conditions recommended by staff to the Planning Commission): <br />• Outdoor events of any type are limited to four times /year, 150 persons total, and 9 <br />a.m. to 9 p.m. (Monday- Sunday). * <br />• At least two Masonic members must be on -site during any outdoor events to monitor <br />noise levels at the property line and enforce noise standards. <br />• Total number of persons on -site at any given time is limited to 150. <br />• The list of allowed uses /occupants is restricted to the Masonic Center and affiliated <br />organizations, celebrations, indoor training /education (but not lasting more than three <br />consecutive days), catering (no more than five staff members) and public uses (e.g., <br />poll stations). <br />• Indoor Masonic activities are limited to 9 a.m. to 9 p.m. (Monday- Sunday) and indoor <br />non - Masonic activities (e.g., seminars, catering) are limited to 9 a.m. to 5 p.m. <br />(Monday- Friday) and 9 a.m. to 9 p.m. (weekends). <br />• The existing French /double door in the back of the Masonic Center building that <br />generated numerous complaints from the Millers will be replaced with a solid door and <br />can be used for emergency use only (with exceptions for the outdoor events allowed <br />four times per year). * <br />• No music is allowed outside the building; live or recorded music is only allowed inside <br />the building with the doors closed. <br />• All exterior lights will be shielded to reduce glare and placed on automatic timer, and <br />lights on the north side of the building (facing the Millers) will be turned off at 10 p.m. <br />• The outdoor areas must be maintained in an orderly manner, with only three <br />accessory structures allowed. * <br />Page 9 of 13 <br />
