Resolution No. PC- 2016 -18 <br />Page Two <br />2. The proposed location of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental to the public health, <br />safety, or welfare, or materially injurious to the properties or improvements in the <br />vicinity. <br />Condition 20 of UP -77 -13 required the Masonic Lodge to "provide an effective buffer <br />between the development and the single family residential area surrounding the <br />property." The staff report for the public hearing on June 22, 2016, detailed incidents in <br />2008 and 2009 (where police response was required) and which demonstrate that the <br />Lodge was not in compliance with condition number 20. At the June 22, 2016 hearing, <br />more than a dozen residents living in the vicinity of the Lodge voiced their concerns to <br />the Planning Commission regarding noise and other issues at the Lodge demonstrating <br />that the Lodge was not in compliance with condition number 20. <br />With the revised conditions adopted by the Planning Commission on June 22, the <br />operations of the Masonic Lodge will not have a detrimental impact on the public health, <br />safety, or welfare, or be materially injurious to the properties or improvements in the <br />vicinity. These conditions include but are not limited to setting hours of operation, <br />allowable activities within and outside of the building, building capacity, and allowable <br />levels of noise and light in order to ensure that the Masonic Lodge will not adversely <br />affect residential properties in the area. Therefore, this finding can be made. <br />3. The proposed conditional use will comply with each of the applicable provisions <br />of the Municipal Code which apply to conditional uses. <br />The Pleasanton Municipal Code states that because of the unusual or uncharacteristic <br />nature of some proposed land uses, conditional uses require special consideration so <br />that they may be located properly with respect to their effects on surrounding properties. <br />The revised conditions establish operational parameters for the Masonic Lodge and will <br />bring its operation into compliance with the applicable provisions of the Pleasanton <br />Municipal Code, particularly those related to noise. Therefore, this finding can be made. <br />WHEREAS, the Planning Commission determined that with the revised conditions of <br />approval, the existing use will be compatible with the surrounding <br />neighborhood. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br />Section 1. <br />Approves the modifications to UP -77 -13 to allow continue operation of the <br />Masonic Lodge at 3370 Hopyard Road, subject to the conditions shown in <br />Exhibit A, attached hereto and made part of this case by reference. <br />
