ORDINANCE NO. <br />ATTACHMENT 1 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />APPROVING THE APPLICATION OF CATALYST DEVELOPMENT FOR <br />PLANNED UNIT DEVELOPMENT (PUD) REZONING AND DEVELOPMENT <br />PLAN APPROVAL, AS FILED UNDER CASE PUD -120 <br />WHEREAS, Catalyst Development applied for: 1) rezoning of three parcels <br />totaling approximately 31,798 square feet from RM -1,500 (Multi - Family Residential) to <br />PUD -HDR (Planned Unit Development — High Density Residential) District; 2) PUD <br />Development Plan approval to retain and relocate the existing single - family residence <br />on -site and construct 10 two -story townhomes and related site improvements located at <br />536 and 550 St. John Street and the vacant parcel to the east of 536 St. John Street <br />(the "Project"); and <br />WHEREAS, after a March 23, 2016 workshop, at its meeting of August 24, 2016, <br />with a 5 -0 vote, the Planning Commission determined that the rezoning and <br />development plan are appropriate for the site, made the findings, and recommended to <br />the Pleasanton City Council that PUD -120 be approved; and <br />WHEREAS, on September 20, 2016, the Pleasanton City Council held a duly <br />noticed public hearing on this application and considered all public testimony, agenda <br />reports, and related materials, and the recommendations of City staff and the Planning <br />Commission; <br />WHEREAS, after a review of the materials presented, the Pleasanton City <br />Council determines that the proposed PUD rezoning and development plan are <br />consistent with the City's General Plan, Downtown Specific Plan, and purposes of the <br />PUD ordinance, and by this reference adopts and reaffirms all of the considerations and <br />findings set forth in Planning Commission resolution; and <br />WHEREAS, the Pleasanton City Council determined that the proposed project <br />was adequately analyzed in the certified Environmental Impact Report (EIR) for the <br />Downtown Specific Plan and no further environmental review is required pursuant to the <br />California Environmental Quality Act (CEQA). <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br />Section 1. Approves the rezoning of 536 and 550 St. John Street and the vacant <br />parcel to the east of 536 St. John Street from RM -1,500 (Multi - Family Residential) <br />District to PUD -HDR (Planned Unit Development — High Density Residential) District. <br />Section 2. The Zoning Map of the City of Pleasanton, on file with the City Clerk, <br />designating and dividing the City into zoning districts, is hereby amended to Zoning Unit <br />Map No. 500, attached hereto as Exhibit B, dated September 20, 2016, and <br />incorporated herein by this reference. <br />
