BACKGROUND <br />On March 1, 2016, as part of the 2016 LPFD Weed Abatement Program, the City <br />Council adopted Resolution No. 16 -833, which declared that weeds on specified <br />properties constituted a public nuisance, ordered the abatement thereof, and set a <br />public hearing to hear objections to the proposed abatement. On April 19, 2016, the <br />City Council adopted Resolution No. 16 -843, which ordered the abatement of weeds on <br />the parcels identified in Resolution No. 16 -833 and declared that the weed abatement <br />costs, including a 100% mark up charge for administrative costs, are the responsibility <br />of the property owner. <br />This agenda report is the third and final agenda report to the City Council regarding the <br />2016 Weed Abatement Program. After the deadline of May 31, 2016, fire inspectors re- <br />surveyed the parcels for compliance. A contractor hired by the City abated the weeds <br />and reduced the hazard on one (1) parcel which was noncompliant after the May 31, <br />2016 deadline. <br />The Government Code provides that the abatement costs, including the administrative <br />costs for enforcement, are recoverable and constitute a special assessment against the <br />parcels that are abated. After the assessment is made, unless an exception applies, a <br />lien attaches on the parcel upon recordation of the order confirming the assessment and <br />the lien will be included on the property owner's regular tax bill for the parcel requiring <br />abatement. Property owners have until July 19, 2016 at 5:00 pm to pay the invoice to <br />avoid it being placed on their tax bill. An itemized report showing the cost of weed <br />abatement on a lot -by -lot basis throughout the City is attached to the resolution that <br />accompanies this agenda report. <br />DISCUSSION <br />Staff recommends that at this hearing, after considering any and all objections to the <br />proposed abatement, the City Council should overrule any objections to the proposed <br />abatement and /or move to amend the list of properties abated. <br />Submitted b <br />Ruben Torres <br />Fire Chief <br />Attachments: <br />1.
