select a subcommittee comprising of two members to draft the rebuttal. With only one <br />week between the due dates for the direct argument and rebuttal, only a special meeting <br />would permit three or more Councilmembers to discuss the language of the rebuttal. For <br />the rebuttal, the Council would have options, as detailed above, for third parties or other <br />Councilmembers (not editing) to sign the rebuttal. <br />Council's decision regarding the direct and rebuttal arguments will be included in the <br />attached resolution. <br />Handling of Zone during Pendency of Initiative. <br />Environmental analysis and public meetings regarding the Zone have been on -going <br />since publication of the Notice of Preparation for the Draft Supplemental Environmental <br />Impact Report in August 2014. At the recent joint City Council and Planning Commission <br />workshop regarding the Zone on April 12, 2016, direction was provided to staff to <br />continue the analysis and public process allowing for consideration of the Zone. The <br />next steps would be public hearings before the Planning Commission, and then the City <br />Council, regarding the Zone's General Plan amendments, rezoning, and consideration of <br />the Supplemental Environmental Impact Report. <br />In advance of a vote on the initiative, staff can proceed with consideration of the Zone, or <br />pause to await the outcome of the initiative. If Council provides direction to proceed with <br />consideration of the Zone, both the proposed project with club retail / Costco will <br />continue to be evaluated by staff, along with existing Alternative 2 — Reduced Retail that <br />eliminates club retail uses. At this point, most of the documentation needed to present <br />the Zone to Planning Commission and City Council for consideration (including a <br />comprehensive response to public comments received on the Draft Supplemental <br />Environmental Impact Report) are ready. Continuing to proceed could inform the public, <br />as well as provide environmentally studied options for either voter result. If Council <br />advises that the Zone should be paused, then no action will be taken until there is a final <br />decision on the initiative. <br />Conclusion. Staff recommends that the Council: <br />- Accept the Registrar of Voter's certification of the Citizens for Planned Growth in the <br />Johnson Drive Economic Development Zone initiative <br />- Provide direction about whether the Council wants an Elections Code report on the <br />effects of the initiative <br />- If an Elections Code report is requested, provide direction about the topics to be <br />addressed and a date (August 9th special meeting or August 16th regular meeting) when <br />the Elections Code report should be presented <br />- If no Elections Code report is requested, adopt a resolution placing the initiative on <br />the November 8, 2016 ballot, including language for a ballot question, asking for an <br />impartial analysis, setting due dates for arguments, decide whether the Council will write <br />an argument opposing measure, and which Councilmembers will write such arguments <br />6 <br />
