Attachment 6 <br />RESOLUTION NO. 16- <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, SETTING <br />PRIORITIES FOR FILING WRITTEN ARGUMENTS REGARDING AN INITIATIVE <br />MEASURE AND DIRECTING THE CITY ATTORNEY TO PREPARE AN IMPARTIAL <br />ANALYSIS <br />WHEREAS, a General Municipal Election is to be held in the City of Pleasanton, California, on <br />November 8, 2016, at which there will be submitted to the voters the following initiative measure: <br />"An initiative measure proposing to amend the City of Pleasanton's <br />General Plan to prohibit retail uses of 50,000 square feet or greater in <br />the Johnson Drive Economic Development Zone" <br />WHEREAS, as provided by Elections Code § §9281 et seq., the City may allow direct and <br />rebuttal ballot arguments regarding the initiative measure; and <br />WHEREAS, Elections Code §9282 permits the City Council to write an argument against the <br />initiative measure. <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br />SECTION 1. Establishes August 18, 2016 and August 25, 2016, respectively, as the deadlines <br />for submission of direct arguments and rebuttal arguments for the measure. Direct arguments not <br />exceeding 300 words and rebuttal arguments not exceeding 250 words regarding the measure as <br />specified above, shall be accompanied by the printed name(s) and signature(s) of the author(s) <br />submitting it, in accordance with Elections Code § 9283. The arguments may be changed or withdrawn <br />until and including the date fixed by the City Clerk after which no arguments for or against the initiative <br />measure may be submitted to the City Clerk. The arguments shall be accompanied by the Form of <br />Statement to Be Filed by Author of Argument. <br />SECTION 2. Authorizes and to write on behalf of the "Pleasanton <br />City Council" a direct argument against the initiative measure; authorizes and <br />to write on behalf of the "Pleasanton City Council" a rebuttal to the direct argument in favor of the <br />measure; gives preference and priority to such arguments pursuant to Elections Code §§ 9282(b) and <br />9287; and delegates to the aforementioned writers the authority to select other persons to sign such <br />arguments. <br />SECTION 3. Gives preference and priority to the argument in favor of the initiative measure as <br />provided in Elections Code §§ 9282(a) and 9287. <br />SECTION 4. The city attorney shall prepare and submit by July 28, 2016 an impartial analysis <br />of the initiative measure not exceeding 500 words showing the effect of the initiative measure on the <br />existing law and the operation of the initiative measure as provided in Elections Code §9280. <br />PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a <br />regular meeting held on July 19, 2016. <br />1, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing resolution <br />was adopted by the City Council at a regular meeting held on July 19, 2016, by the following vote: <br />
