B. Uses outside the building envelopes for Lot 1 and Lot 2: <br /> 1) Permitted Uses: <br /> a) vineyards, orchards, and other row crops for non-commercial purposes <br /> b) horticulture for non-commercial purposes <br /> c) pump station on Lot 2 <br /> d) the keeping of farm animals, as follows: <br /> (i) for lots of at least five acres of open space, one swine per 2.5 acres; <br /> maximum of eight animals; <br /> (ii) for lots of at least five open space, one large fowl (goose, turkey) per <br /> acre; maximum of ten animals <br /> (iii) for lots with at least 1.5 acres of open space; <br /> - fifty small fowl (chickens, duck, Guinea fowl) or rabbits per acre <br /> - one head of cattle, horse, or donkey per 1.5 cares <br /> - one sheep or goat per 0.75 care <br /> - any other farm animal subject to the type and quantity approved <br /> by the Planning <br /> B. Uses for the reminder parcel (Berlogar existing home site) shall be those indicated <br /> in PUD-05 (Ordinance No. 1832) applicable to the remainder parcel (hillside <br /> residential and open space designations). <br /> 3. The project applicants shall pay any and all fees including Agricultural Mitigation Fee <br /> required by the Vineyard Avenue Corridor Specific Plan to which the property may be <br /> subject prior to issuance of permits. The type and amount of the fees shall be those <br /> in effect at the time the permit is issued. <br /> 4. No building permits shall be issued prior to City approval and recordation of a Parcel <br /> Map. <br /> 5. The applicant shall create road and utility easements approved by the City Engineer <br /> to allow the owners of Lot 1, Lot 2, and the designed remainder parcel to utilize the <br /> private road and utilities. The easement language shall be subject to review and <br /> approval by the City Attorney's Office prior to recordation of the final parcel map. The <br /> easement shall be maintained to the satisfaction of the City Engineer. <br /> 6. The applicant shall create a maintenance agreement including the maintenance <br /> responsibility of the private road, entrance gate, existing pump house, utilities, storm <br /> water treatment system, etc. in perpetuity. The maintenance agreement is subject to <br /> review and approval by the City Attorney's Office and shall be recorded concurrently <br /> with the Final Parcel Map. The Maintenance Agreement shall include exhibits showing <br /> the location of all the common private improvements to be maintained. The City shall <br /> be granted the rights and remedies of the agreement, but not the obligation, to enforce <br /> the maintenance responsibilities of the agreement. <br /> PUD-116, Beriogar Page 2 <br />
