Purchaser acknowledges that the City of Pleasanton, owner of the Pleasanton Pioneer Cemetery, intends to maintain the Cemetery at a "Pioneer level"which means the cemetery will have no formal irrigation system and will be irrigated by naturally-occurring rain only. The City will be responsible for regular trash pickups from City-installed waste cans, and shall conduct appropriate landscaping duties to maintain the Cemetery at the "Pioneer level" as determined by the Parks Maintenance Superintendent." 4. Types of Memorials Permitted. Only one type of memorial shall be permitted on the new plots at the Cemetery. The memorial shall consist of a single 28-inch by 20-inch lawn-level granite memorial placed on the burial plot or the plot for cremated remains. CFCS and City specifically reserve the right to limit and approve the size, type style and content of any lettering, emblems, floral tributes, photographs or any other object affixed to, or placed upon, the burial spaces or niches in accordance with its Rules and Regulations in force from time to time. 5. Funeral Services, Memorials, Caskets, etc. Persons who wish to buy plots within the Pleasanton Pioneer Cemetery must purchase those plots as well as a burial service from CFCS. Persons who purchase plots within the Pleasanton Pioneer Cemetery are not, however, obligated to purchase funeral services, memorials, caskets, etc. from CFCS. Purchaser may contact other vendors to perform these services or provide these products. 6. Rights Not Included. The Purchase Price does not include any charges for, or rights with respect to: inscriptions, installation of memorials or any other services, products or documents customarily required or provided in connection with an interment, including, without limitation, any charges customarily billed by a funeral director. 7. Condition Precedent to Ownership Rights — Payment of Purchase Price. With respect to the Rights being purchased and sold hereunder, no interments may be made, no memorials may be placed, and no right of ownership or possession or any other rights shall pass to the Purchaser until the Purchase Price, including all installment payments related thereto, have been paid in full. 8. Default by the Purchaser in Payment of Purchase Price. If the Purchaser fails to make timely payment of any installment payment, this action shall be considered a default by Purchaser, and CFCS shall have the right to immediately cancel this Agreement.
