EXHIBIT A <br /> SCOPE OF WORK & OTHER CONTRACT TERMS <br /> A. SALES OF PLOTS AND VAULTS BY CFCS <br /> CFCS will handle the sales of the new plots and vaults recently installed at the Cemetery. CFCS will <br /> rely upon the prices approved by the City on a form approved by the City. (See Section I below for <br /> the approved form and Exhibit B for the approved prices.) <br /> Upon making a sale of a vault and plot, CFCS will collect the funds from the purchaser. CFCS will <br /> distribute the funds from the sale as follows. <br /> 1. If the Purchaser pays in full, CFCS shall distribute the funds as follows: <br /> a. CFCS shall receive the administrative fee. <br /> b. If plots for cremated remains were purchased, CFCS shall also receive the urn vault <br /> fee and shall store the urn vaults until the burial service is needed. <br /> c. For full-size plots (plot fees), CFCS will distribute the plot fee, which includes the <br /> pre-installed full-size, double depth vault, to the City. <br /> d. For cremated-remains plots (plot fees), CFCS will distribute the plot fee to the City. <br /> e. CFCS shall receive the burial service fee as a deposit in full for the delivery of the <br /> future burial service to be provided. CFCS shall be responsible for the investment of <br /> said deposit and shall be entitled to any income derived from said deposit. In the <br /> event of termination of this agreement, CFCS shall provide repayment of any burial <br /> service fees that have not been delivered at the then current retail price of such <br /> services. The then current retail price shall be the greater of the burial service fee <br /> escalated for consumer price indices in accordance with section D below or the local <br /> market rate for comparable burial services in Alameda County at the time the <br /> contract is terminated. <br /> 2. If the Purchaser pays by installment plan, as funds are received, CFCS will place <br /> the funds in an account. City shall be a co-signor on this account. The funds <br /> received from the Purchaser shall remain in the account until payment has been <br /> made in full unless this agreement is terminated in which case all funds will be paid <br /> to the City immediately except the 15% non-refundable deposit which shall be <br /> retained by CFCS. Once payment has been made in full by Purchaser, CFCS shall <br /> distribute the funds according to Section A.1 above. <br /> B. RECORDKEEPING <br /> CFCS will be responsible for all accounting and record-keeping related to purchases, distributions, all <br /> accounts, collections, and fulfillments over time. CFCS will provide the City with an income and cash <br /> distribution report, and a report on the accounts on a monthly basis. CFCS shall maintain records of <br /> ownership for all plots and vaults, and shall provide that information, including a copy of each <br /> Purchase Agreement, on a quarterly basis to the City's Parks and Community Services Director or <br /> 1 <br />
