10,4617 <br /> CEMETERY SERVICES AGREEMENT <br /> RELATED TO VAULTS & PLOTS INSTALLED IN 2010 <br /> THIS CEMETERY SERVICES AGREEMENT("Agreement") is made and entered into this <br /> Z day of July 2010 between Catholic Funeral&Cemetery Services("CFCS"),whose address is <br /> 1965 Reliez Valley Road, Lafayette, CA 94549 and telephone number is 925.946.1440 and the City of <br /> Pleasanton, a municipal corporation("City"). <br /> RECITALS <br /> A. In 2007, the City acquired the Pleasanton Memorial Gardens Cemetery on Sunol <br /> Boulevard from the Trustees of Pleasanton Lodge No. 255 of the Independent Order of Odd Fellows <br /> ("Cemetery"). <br /> B. In February 2007,the City and CFCS entered into a contract whereby CFCS agreed to <br /> provide burial services for those persons who pre-paid for existing plots within the Cemetery. <br /> C. In September 2009, the City and CFCS entered into a contract whereby CFCS agreed to <br /> install 200 full-size, double depth concrete burial vaults,spaces for 200 cremated remain plots, and mark <br /> the locations of all 400 new plots. <br /> D. The City now desires to have CFCS act as its agent and sell the new plots and vaults that <br /> were recently installed by CFCS. This is a new agreement and does not affect the prior agreements <br /> entered into between CFCS and the City. <br /> E. CFCS is qualified and experienced in providing burial, monument,and related services. <br /> NOW THEREFORE, in consideration of the mutual covenants and conditions in this <br /> Agreement, City and CFCS agree as follows: <br /> 1. Services to be Performed. CFCS shall perform all duties described in Exhibit A,attached <br /> hereto and incorporated herein the"Services". <br /> 2. Equipment to be Made Available. The City shall make available to CFCS for the term of <br /> this Agreement the backhoe and lowering device that the City acquired from the Independent Order of <br /> Odd Fellows. CFCS shall maintain this equipment for use for burial and monument services at the <br /> Cemetery. CFCS shall store the backhoe and lowering device on adjacent property controlled by CFCS. <br /> Upon termination of this Agreement,this equipment shall be returned by CFCS to the City,along with <br /> all maintenance records from the period of CFCS's use. <br /> 3. Meeting Space to be Made Available. The City may make meeting space and/or a <br /> conference room available to CFCS staff upon prior request to provide CFCS's family service counselor <br /> a location to meet persons and families who desire to make burial and monument arrangements at the <br /> Cemetery. When CFCS requires such space,it will contact the City's designated staff person by <br /> Page 1 of 4 <br />
