ATTACHMENT 3 <br /> THIRD AMENDMENT TO AGREEMENT <br /> This Third Amendment to Agreement entered into this 7 day of June 2016 by the City of Pleasanton <br /> ("City") and Catholic Funeral & Cemetery Services, also known as CFCS ("Contractor") <br /> A. Whereas, on July 27, 2010, CFCS and the City entered into a Cemetery Services Agreement <br /> ("the Agreement") , which Agreement was amended on August 13, 2015 and on December 2, <br /> 2015 for the sole purpose of extending the term of the Agreement to first, December 31, 2015 <br /> and second,to June 30, 2016; and <br /> B. Whereas,The parties now wish to amend the Agreement further concerning the Scope of <br /> Services,the equipment, the payment schedule and the term of the Agreement; and <br /> Whereas,the parties desire to amend to the Agreement; <br /> Now, therefore, in exchange for valuable consideration, the receipt of which is hereby acknowledged, <br /> the parties agree as follows: <br /> 1. Section 1 of the Agreement, is amended to read: <br /> Services to be Performed. Exhibit A to the Agreement is deleted in its entirety. CFCS will <br /> provide burial services at the Pleasanton Pioneer Cemetery including interment and disinterment <br /> services. CFCS will install cement vaults(provided by City)prior to burials in the Old Section of <br /> the Cemetery. CFCS will install grave markers as needed. City or its designated contractor will <br /> mark the exact location that the interment, disinterment and/or monument setting is to take place. <br /> City or designated contractor will also coordinate with CFCS to determine the date and time of <br /> burial services and installation of grave markers. <br /> 2. Section 2 of the Agreement is amended to read: <br /> Equipment to be Made Available. The City shall make available to CFCS lowering <br /> device owned by the City ("the equipment"). The City shall maintain the equipment for <br /> use for burial and monument services at the Cemetery by CFCS. At the termination of <br /> this Agreement, CFCS shall return the equipment to the City. <br /> 3. Section 4 of the Agreement is amended to read: <br /> Compensation. By July 31, 2016,the City will pay CFCS a non-refundable <br /> administrative fee in the amount of$5000. For burial services once provided, for the <br /> installation of cement vaults and for disinterment, CFCS shall invoice the City as follows: <br /> a. Burial Fee, Ground– full opening $995 <br /> b. Burial Fee, Ground - cremation inurnment $375 <br /> c. Weekend burial services overtime fee To be determined <br /> upon request <br /> d. Preparing graveside for service with lawn greens, <br /> chairs, and canopy Included in above fee <br /> e. Installation of cement vaults (casket) in old section <br /> as needed (vaults provided by City) $1395 <br /> c. Installation of grave markers- Flush 28 x 20 $275 <br /> d.
