ORDINANCE NO. 2141 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE APPLICATION OF GUY HOUSTON OF VALLEY CAPITAL <br /> REALTY FOR PUD DEVELOPMENT PLAN APPROVAL, AS FILED UNDER <br /> CASE PUD-115 <br /> WHEREAS, Guy Houston of Valley Capital Realty, has applied for Planned Unit <br /> Development (PUD) development plan approval to retain the existing residence and <br /> second unit and construct two new detached single-family homes on new separate lots <br /> on an approximately 2.93-acre site located 11249 Dublin Canyon Road; and <br /> WHEREAS, an Initial Study/Negative Declaration was prepared for the previously <br /> approved, but now expired, development plan (PUD-44) for this same site in 2006. The <br /> proposed development is substantially consistent with the previously approved PUD-44, <br /> which was analyzed in the Initial Study/Negative Declaration. No new information or <br /> changed circumstances have been identified, per California Environmental Quality Act <br /> (CEQA) Guidelines Section 15162 that would require supplemental environmental <br /> review; and <br /> WHEREAS, at its meeting of April 19, 2016, the City Council received a report from <br /> the Director of Community Development, including the Planning Commission's <br /> recommendations for approval of PUD-115; and <br /> WHEREAS, the City Council held a public hearing on April 19, 2016, at which time <br /> the applicant and other members of the public were offered an opportunity to present <br /> information regarding this application; and <br /> WHEREAS, after a review of the materials presented, the City Council determines <br /> that the PUD plan is consistent with the General Plan and the purposes of the PUD <br /> ordinance based on the findings set forth in the report presented to the City Council on <br /> April 19, 2016, and information presented at the public hearing. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOES HEREBY ORDAIN AS FOLLOWS: <br /> Section 1. The City Council finds that the project is consistent with the Pleasanton <br /> General Plan and the PUD District ordinance, and that the project is consistent with the <br /> negative declaration previously prepared for an earlier rezoning of this site. <br /> Section 2. The City Council approves Case PUD-115 the application of Guy <br /> Houston of Valley Capital Realty for a Planned Unit Development (PUD) development <br /> plan (Case PUD-115) to retain the existing residence and second unit and construct two <br /> new detached single-family homes on new separate lots on an approximately 2.93-acre <br />
