listed; and directly or indirectly accept-
<br /> ing or asking anything of value therefor
<br /> as a fee, compensation, gift, gratuity or
<br /> reward;
<br />
<br /> c. To make, sell or give away; any charm, talis-
<br /> man, potion or other magic thing or anything
<br /> purporting to be such.
<br />
<br /> ~4-4.19 Exemptions.
<br />
<br /> a. Religious Institutions. The provisions of
<br /> ~4-4.17 and ~4-4.18 shall not be construed
<br /> to include, prohibit or interfere with the
<br /> exercise of any religious or spiritual func-
<br /> tion of any priest, minister, rector, or any
<br /> accredited representative of any bona fide
<br /> church or religion when such priest, minister,
<br /> rector, or accredited representative holds a
<br /> certificate of credit, commission, or ordina-
<br /> tion under the ecclesiastical laws of a re-
<br /> ligious corporation incorporated under the
<br /> laws of any state or territory of the United
<br /> States of America, of any voluntary religious
<br /> association, and who fully conforms to the
<br /> rites and practices prescribed by the supreme
<br /> conferences, convocation, convention, assembly,
<br /> association, or synod of the system or faith
<br /> with which such priest, minister, rector, or
<br /> accredited representative is affiliated; pro-
<br /> vided, however, any church or religious or-
<br /> ganization which is organized for the primary
<br /> purpose of conferring certificates of commis-
<br /> sion, credit, or ordination for a price, and
<br /> not primarily for the purpose of teaching
<br /> and practicing a religious doctrine or be-
<br /> lief, shall not be deemed to be bona fide
<br /> church or religious organization.
<br />
<br /> b. Newspapers and Periodicals Entertainment Feature~
<br /> The provisions of Section 4-4.17 and 4-4.18
<br /> shall not be construed to include, prohibit or
<br /> interfere with the sales or distribution of
<br /> any newspaper, magazine or periodical, solely
<br /> because it contains as an entertainment feature
<br /> horoscopes or astrological forecasts.
<br />
<br />Section 2. If any section, subsection, subdivision, paragraph,
<br /> sentence, clause or phrase of this ordinance or any part
<br /> thereof is for any reason held to be unconstitutional,
<br /> such decisions shall not effect the validity of the re-
<br /> maining portions of this ordinance or any part thereof.
<br /> The City Council hereby declares that it would have
<br /> passed each section, subsection, subdivision, paragraph,
<br /> sentence, clause or phrase irrespective of the fact that
<br /> any one or more of the sections, subsections, subdivis-
<br /> ions, paragraphs, sentences, clauses or phrases be de-
<br /> clared unconstitutional.
