ATTACHMENT 3 <br /> SECOND AMENDMENT TO AGREEMENT <br /> This Second Amendment to Agreement("Second Amendment") is entered into this 17th day of <br /> May, 2016 by the City of Pleasanton("City") and Kimley Horn and Associates, Inc.("Consultant"). <br /> Whereas, on April 21, 2015,the City and Consultant entered into a Design Professional Services <br /> Agreement for Professional Services ("Agreement") (Agreement 15-1332C) where Consultant is <br /> providing design services for Stanley Boulevard Undergrounding Utility District Overhead Conversion <br /> and Roadway Reconstruction, CIP 055022 project; and <br /> Whereas, on October 16, 2015, the City Manager entered into First Amendment for the Design <br /> Professional Services Agreement for Professional Services (Agreement 15-1332C)where the first <br /> amendment extended the term of the agreement, increased the scope and fee of the contract for <br /> Consultant design services for Stanley Boulevard Undergrounding Utility District Overhead Conversion <br /> and Roadway Reconstruction, CIP 055022 project; and <br /> Whereas,additional time and services are needed from Consultant to complete additional design <br /> work; and bid and construction support services; and <br /> Whereas,the parties desire to amend the Agreement to extend the time and compensation for <br /> such additional services. <br /> Now,therefore, in exchange for valuable consideration,the receipt of which is hereby acknowledged, <br /> the parties agree as follows: <br /> 1. Exhibit A of the Agreement is amended to add the following "Proposal—Design Consultant <br /> Services for Stanley Blvd. between Main St. and First St. for Bid and Construction Support <br /> Services, Request for Additional Services Authorization dated April 21, 2016." <br /> 2. Section 4 Term of the Agreement shall be extended to June 30, 2017. <br /> 3. The total compensation for services and reimbursement listed under Section 5 Compensation <br /> of the Agreement shall be increased by $358,500 to $657,010. <br /> 4.
