ATTACHMENT 3 <br /> RESOLUTION NO. 16- <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON ORDERING <br /> THE SUMMARY VACATION OF EXCESS RIGHT OF WAY ON OWENS DRIVE, <br /> WILLOW ROAD, AND GIBRALTAR DRIVE <br /> WHEREAS, on July 27, 1982, the City Council adopted Resolution 82-262 that accepted <br /> a dedication deed for public streets within Hacienda Business Park that included Owens Drive, <br /> Willow Road, and Gibraltar Drive and instructed staff to take whatever action necessary to <br /> implement said acceptance; and <br /> WHEREAS, on August 13, 1982 the dedication deed granting real property to the City of <br /> Pleasanton that included Owens Drive, Willow Road, and Gibraltar Drive was recorded at the <br /> County of Alameda Clerk-Recorder's Office; and <br /> WHEREAS, on May 1, 2012, the City Council adopted Ordinance No. 2035 approving <br /> PUD-85-08-12D that included Condition of Approval No. 72 requiring portions of existing street <br /> right of way and public service easements (PSE) along Owens Drive and Willow Road to be <br /> vacated and new PSEs granted to the City; and <br /> WHEREAS, on May 1, 2012, the City Council adopted Ordinance No. 2036 approving <br /> PUD-81-30-86D including Condition of Approval No. 57 requiring portions of existing street right <br /> of way and public service easement (PSE) along Gibraltar Drive to be vacated and new PSE <br /> granted to the City; and <br /> WHEREAS, the City Council finds that certain right of way along Owens Drive, Willow <br /> Road, and Gibraltar Drive are no longer needed for street or highway purposes and are in excess <br /> of the City's needs. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: <br /> SECTION 1.The City Council finds that the street right of way on Owens Road and Willow <br /> Road along the 4863 Willow Road property and the street right of way on Gibraltar Drive dedicated <br /> as real property to the City of Pleasanton, as shown on Attachment 1, by a dedication deed <br /> recorded on August 13, 1982 is excess property, is not needed for street purposes, and orders <br /> that it be summarily vacated pursuant to Section 8334(a) of the Streets and Highway Code. <br /> SECTION 2.The City Council finds that public service easements that run along the street <br /> right of way to be vacated are no longer needed and orders the easements to be vacated. <br /> SECTION 3. The City will quitclaim the excess property along Owens Road and Willow <br /> Road and along Gibraltar Drive to the current owners of 4863 Willow Road (APN 941-2778-13) <br /> and Gibraltar Drive (APN 941-2778-11), respectively. <br /> SECTION 4. The City Manager is authorized to execute the quitclaim deeds and the City <br /> Clerk is directed to cause such documents to be recorded in the Alameda County Records. <br /> SECTION 4. The City Clerk shall certify to the passage of this resolution and enter it into <br /> the book of original resolutions. <br />
