EXHIBIT A <br /> GROWTH MANAGEMENT AGREEMENT <br /> THIS GROWTH MANAGEMENT AGREEMENT is made and entered into on the day of <br /> , 2016, between Ponderosa Homes II, Inc., a California Corporation <br /> ("Developer"), and the City of Pleasanton, a municipal corporation ("City"). <br /> RECITALS <br /> A. Developer owns a legal or equitable interest in real property commonly known as <br /> 1851 Rose Avenue (the "Subject Property") in the City of Pleasanton. <br /> B. The City has granted to Developer development plan approval (PUD-99) to build <br /> nineteen (19) new detached single family homes on the Subject Property (the "Project"). <br /> C. Section 17.36.060 of the Pleasanton Municipal Code (Growth Management <br /> Program) establishes annual new residential limits. For 2016, there are 235 growth <br /> management unit allocations. The City has reviewed the growth management unit allocations <br /> established for 2016 and determined that the growth management unit allocation capacity is <br /> available for the Project. <br /> D. City may enter into growth management agreements with project developers under <br /> the City's Growth Management Program. <br /> E. City and Developer wish to enter into a growth management agreement in order to <br /> achieve the benefits of the Project to the City and its residents and in accordance with the <br /> purposes of the City's Growth Management Program. <br /> NOW, THEREFORE, in consideration of the mutual promises expressed herein, City and <br /> Developer agree as follows: <br /> I. GROWTH MANAGEMENT APPROVAL <br /> A. City grants growth management approval to the Project for nineteen (19) units in 2016. <br /> Developer may be issued building permit(s) in the year(s) following 2016 until <br /> Developer has received building permits for all units. <br /> B. The growth management approval and assigned units (the "GMA units") described in <br /> Subsection A, above, shall be suspended during any period that the City Council has <br /> declared a Stage 4 reduction in water usage pursuant to Pleasanton Municipal Code <br /> Chapter 9.30 Water Conservation Plan. New building permits shall not be issued for <br /> GMA units during such suspension. If such a suspension is discontinued when the <br /> City is no longer in a Stage 4 reduction in water usage, Developer shall have the right <br /> to utilize the GMA units that had been suspended even if in a subsequent calendar <br /> year. <br /> 1 <br />
