4.4. Exculpatory Clause-All Trustees. No trustee shall be liable to any person interested <br /> in this trust for any act or default unless it results from the trustee's bad faith,willful misconduct, <br /> or gross negligence. <br /> 4.5. Waiver of Liability for Predecessor Trustee. Any successor trustee may accept as <br /> correct any accounting of trust assets made by any predecessor trustee. However,a successor <br /> trustee may institute any action or proceeding for the settlement of the accounts,acts,or <br /> omissions of any predecessor trustee. <br /> 4.6. Trustee Statutory Powers.In addition to any powers now or hereafter conferred on <br /> trustees by law,the trustee shall have all the powers listed in Article 2,commencing with Section <br /> 16220,of Chapter 2 of Part 4 of Division 9 of the California Probate Code. <br /> 4.7. Advisors.The trustee may hire and pay from the trust the fees of investment <br /> advisers,accountants,tax advisers,agents,attorneys,and other assistants for the administration <br /> of the trust and for the management of any trust asset and for any litigation affecting the trust. <br /> 4.8. Administrative Provisions. The following administrative provisions shall apply to <br /> this trust: <br /> 1. The trustee is entitled to reasonable compensation for ordinary and <br /> extraordinary services,and for all services in connection with the complete or partial termination <br /> of this trust. <br /> 2. All persons who have any interest in this trust are bound by all discretionary <br /> determinations the trustee makes in good faith under the authority granted under this trust. <br /> 4.9. Bond-Waiver. No trustee,including a nonresident,shall be required to post bond <br /> or security. <br /> 4.10. Beneficiary's Last Illness and Funeral Expenses. The trustee shall have the power, <br /> in the trustee's reasonable discretion,to pay the last illness expenses,funeral expenses,and other <br /> obligations incurred for the beneficiary's support from the beneficiary's trust. <br /> 4.11. Duty to Account. The trustee shall render accounts at least annually,at the <br /> termination of a trust,and on a change of trustees,to the persons and in the manner required by <br /> law. <br /> ARTICLE FIVE <br /> EXECUTOR <br /> 5.1.
