ATTACHMENT 3 <br /> Agreement regarding Historic Recognition Program <br /> This Agreement is made between Amador-Livermore Valley Historical Society, a California non- <br /> profit corporation ("Historical Society"), and Pleasanton Heritage Association, a California non-profit <br /> corporation ("PHA"). <br /> Recitals <br /> A. Both the Historical Society and PHA are organizations approved by the IRS as IRS Code <br /> Section 501(c)(3) organizations which promote education and understanding of Pleasanton local <br /> history. <br /> B. Jean Jones died in 2015. In her will, Jean Jones donated her home and estate to the City of <br /> Pleasanton with direction that if the City could not use the home as a museum or related use that her <br /> estate assets be used for historical building preservation purposes. <br /> C. In implementation of Jean Jones will, the City (Beneficiary) determined that it was infeasible <br /> to use Jean Jones home at 309 Neal Street as a museum. The City has directed that the home and <br /> remaining assets be consolidated into cash for disposition in accordance with the testator's direction. <br /> D. The Executor of Jean Jones will, Peter MacDonald, has determined and proposed that the <br /> use of Estate assets most compatible with the testator's wishes is to put the money into an endowment <br /> for the Historical Society ("Jean Jones Endowment Fund" or"Endowment"). The Historical Society has <br /> established that Endowment Fund and initiated plans for special displays within the Museum on Main <br /> preserving the historical information about 309 Neal Street, and early Pleasanton. The Executor has <br /> determined that use, and general support for the Historical Society, are consistent with the will, and that <br /> an endowment is the use most closely approximating the testator's desires and most likely to support <br /> historic preservation in Pleasanton over the long run. <br /> E. PHA has instituted a program of historic recognition and education memorializing historic <br /> buildings in Pleasanton with annual awards of recognition providing plaques located on the historic <br /> building and providing historic information. The success of the PHA Historic Recognition Program <br /> would be greatly enhanced by long term funding for the cost of procuring and installing the historic <br /> plaques. <br /> F. The Historical Society desires to provide long term funding for the PHA Historic Recognition <br /> Program using the Jean Jones Endowment as the funding source. <br />
