BACKGROUND <br /> On July 13, 2011, the Planning Commission recommended City Council approval of PUD- <br /> 82, a Planned Unit Development(PUD) application by DiDonato Builders, Inc. to construct <br /> 13 single-family homes located at an approximately 1.2-acre site at 4171 and 4189 <br /> Stanley Boulevard. Subsequently, on October 18, 2011, the City Council approved PUD- <br /> 82 and adopted Ordinance No. 2021. <br /> On July 11, 2012, the Planning Commission approved an application by DiDonato <br /> Builders, Inc. for Vesting Tentative Map 7968 to subdivide an approximately 1.2-acre site, <br /> located at 4171 and 4189 Stanley Boulevard, into 13 single-family home lots consistent <br /> with the PUD development plan for this site. <br /> In January of 2013, Kontech USA, Inc. purchased the site from DiDonato Builder, Inc. <br /> The developer has submitted the required disclosure deed; Covenants, Conditions and <br /> Restrictions; agreements; Final Map; Improvement Plans; and other legal documents for <br /> Tract 7968. Engineering and Planning staff and the City Attorney's Office have reviewed <br /> these documents and have found them to be in substantial compliance with the approved <br /> Vesting Tentative Map and PUD-82. Additionally, the developer has paid development <br /> fees including its pro-rata share of the costs of the City's project, CIP No. 055022 - Stanley <br /> Boulevard Reconstruction, and its pro-rata share of the costs of the public storm drain <br /> system installed on Stanley Boulevard by Ponderosa Homes, Inc. (Ponderosa). <br /> DISCUSSION <br /> Proposed Improvements and Maintenance Responsibility <br /> As shown on Attachment 2, the development proposes a new private street accessed <br /> from Stanley Boulevard. The private street, bio-swales for storm water treatment, and <br /> private utilities (including street lights and storm drain systems within the private street) <br /> will be maintained by a homeowners association specifically created for this project. <br /> Additionally, the development proposes to construct the following public improvements <br /> that will be owned and maintained by the City: <br /> 1. A public sanitary sewer main and a public water main within the private street (in <br /> dedicated public easements) and on Stanley Boulevard to serve the 13 lots. <br /> 2. Curb, gutter, sidewalk, storm drain and a concrete valley gutter along the project's <br /> Stanley Boulevard frontage. <br /> The development proposes to connect to a public storm drain system on Stanley <br /> Boulevard that was constructed by Ponderosa as part of Tract 8159. This public storm <br /> drain system benefits Tracts 8159 and 7968. Ponderosa entered into a reimbursement <br /> agreement with the City for this storm drain system and is eligible for reimbursement of <br /> Tract 7968's pro-rata share. In accordance with the reimbursement agreement, the City <br /> is responsible to collect the storm drain pro-rata share from Kontech, USA Inc. when final <br /> map is approved, and in turn pass these funds along to Ponderosa. Kontech, USA has <br /> paid the required pro-rata share. <br /> Page 2 of 3 <br />
