• Ensure that the approval of the jointly-filed subdivision map is not valid until the <br /> associated land use amendment is approved and is in full force and effect (see <br /> proposed §§19.20.110.0 and 19.20.120.B); <br /> • Clarify that in order for a vesting tentative map filed concurrently with a land use <br /> amendment to be deemed complete, the jointly-filed land use amendment <br /> adopted by the City Council must be in full force and effect and the map must <br /> comply with that land use amendment' (see proposed §19.22.060.F); and <br /> • Clarify that a jointly-filed subdivision map, even after approved by the Planning <br /> Commission, may be subject to modification by the City Council in response to <br /> the related land use amendment adopted by the City Council (see proposed <br /> §§19.20.110.0 and 19.20.120.B). <br /> PLANNING COMMISSION ACTION <br /> The Planning Commission held a public hearing on April 13, 2016 to review the proposed <br /> Code amendment. Detailed information on this meeting is provided by Attachment 2, <br /> draft excerpts of the Planning Commission minutes. The Planning Commission indicated <br /> strong support for the proposed Code amendment and unanimously voted to recommend <br /> its approval to the City Council. <br /> PUBLIC NOTICE <br /> Notice of this proposal was published in The Valley Times. Staff has not received any <br /> comments as of the publication of this report, and will forward to the Council any public <br /> comments received after publication of this report. <br /> ENVIRONMENTAL ASSESSMENT <br /> The proposed Municipal Code amendments are exempt from CEQA pursuant to Section <br /> 15061(b)(3), as it has been determined that the text amendments will not cause a <br /> significant negative effect on the environment. <br /> CONCLUSION <br /> The proposed changes to the Pleasanton Municipal Code would allow PUD zoning <br /> requests and PUD development plans to be processed concurrently with subdivision map <br /> requests. The proposed amendment will save time on behalf of staff, the Planning <br /> Commission, City Council, and project proponent, and furthers the City's objectives of <br /> streamlining development services offered by the Community Development and <br /> Engineering Departments. <br /> 1 A tentative map refers to a map made for the purpose of showing the design and improvement of a <br /> proposed subdivision. The approval of a vesting tentative map confers a vested right to proceed with <br /> development in substantial compliance with the city's zoning and subdivision ordinances, policies and <br /> standards in effect on the date the city determines the vesting tentative map application is complete, except <br /> in cases where modifications subsequent to being deemed complete are necessary to comply with state <br /> and federal law or building code requirements, or to uphold public health and safety. <br /> Page 3 of 4 <br />
