04-Ala 680 PM 16.56 <br /> 4.9. To prune shrubs, tree plantings, and trees to control extraneous growth <br /> and ensure STATE standard lines of sight to signs and corner sight <br /> distances are always maintained for the safety of the public. <br /> 4.10. To MAINTAIN, repair and operate the irrigation systems in a manner <br /> that prevents water from flooding or spraying onto STATE highway, <br /> spraying parked and moving automobiles, spraying pedestrians on <br /> public sidewalks/bike paths, or leaving surface water that becomes a <br /> hazard to vehicular or pedestrian/bicyclist travel. <br /> 4.11.To control weeds at a level acceptable to the STATE. Any weed control <br /> performed by chemical weed sprays (herbicides) shall comply with all <br /> laws,rules,and regulations established by the California Department of <br /> Food and Agriculture. All chemical spray operations shall be reported <br /> quarterly (Form LA17) to the STATE to: District 4 Maintenance <br /> Landscape Specialists. This report must include Date,Time,Herbicide, <br /> Rate,and Quantity. <br /> 4.12. MONUMENT,which in the opinion of STATE becomes an operational <br /> concern because it is not adequately maintained or deteriorates to an <br /> unacceptable condition, will be removed by CITY at CITY's expense. <br /> STATE will notify CITY when it has determined that MONUMENT <br /> requires special attention.In the event the CITY fails to maintain,repair, <br /> rehabilitate or remove the MONUMENT in a timely manner, STATE <br /> may remove the MONUMENT upon sixty(60) days' notice to CITY, <br /> and bill the CITY for all costs of removal and restoration of the area. <br /> 4.13. STATE reserves the right to remove MONUMENT at any time due to <br /> construction, rehabilitation or other necessary activities without any <br /> obligation,compensation to,or approval of CITY.STATE may provide <br /> a minimum of sixty (60) days notification to CITY of its intent to <br /> remove MONUMENT to allow for timely removal and salvage by <br /> CITY. <br /> 4.I4. STATE reserves the right to remove or alter any MONUMENT that <br /> presents an immediate safety hazard to the public without delay or <br /> advanced notification to CITY. <br /> 4.15.To keep the entire landscaped area policed and free of litter and <br /> deleterious material. <br /> 4.16. CITY shall not enter or leave MONUMENT area via freeway side <br /> unless an encroachment permit is obtained from STATE permitting <br /> such ingress and egress. <br /> 4.17. All work by or on behalf of CITY will be done at no cost to STATE. <br /> 3 <br />
