EXHIBIT A <br /> CONDITIONS OF APPROVAL <br /> PUD-99 <br /> 1851 Rose Avenue <br /> PROJECT SPECIFIC CONDITIONS <br /> Planning Division <br /> 1. The PUD development plan shall lapse two years from the effective date of this <br /> ordinance or later as approved by a development agreement unless a tentative or <br /> parcel map, as applicable, is approved. If a tentative or parcel map is approved, <br /> the PUD development plan approval shall lapse when the tentative map or parcel <br /> map approval expires. If a final map is recorded before the tentative map or parcel <br /> map expires, then the PUD development plan approval shall not lapse. <br /> 2. The applicant/project developer shall pay any and all fees to which the property <br /> may be subject prior to issuance of permits. The type and amount of the fees shall <br /> be those in effect at the time the permit is issued unless otherwise provided in a <br /> development agreement covering the project. <br /> 3. The lots covered by this PUD development plan shall be subject to the permitted <br /> and conditional uses of the One-Family Residential District as defined in the <br /> Pleasanton Municipal Code. <br /> 4. Unless approved by the Director of Community Development and City Engineer, <br /> no grading/building permits shall be issued prior to City approval of the tentative <br /> map and recordation of a Final Map. <br /> 5. The applicant/project developer shall submit for review draft Conditions, Covenants <br /> & Restrictions (CC&Rs) for the project with the improvement plans and recording <br /> with the final map that creates a homeowners association (HOA). The HOA will <br /> provide ownership and maintenance of the common areas within the project, <br /> including the portion of the arroyo that is located within the project site, as well as <br /> landscaping, street lights, on-site stormwater treatment facilities, the precast wall <br /> on the south side of Rose Avenue along the project frontage, and the trees <br /> screening the golf ball fence/net structure (the screen trees). The CC&Rs shall <br /> include the following: <br /> • HOA obtains from City an easement and right of entry for construction of <br /> the bio-retention area and the precast wall; <br /> • HOA provides certificate of insurance naming City as additional insured <br /> for the bio-retention area and the precast wall on the City right-of-way <br /> property for duration of project; <br /> 1 of 28 <br />
