~2~7.02 Definitions. For the purpose of this chapter, <br />certain words and terms used herein are defined as follows: <br /> <br /> a. "Heritage Tree" shall mean any of the following: <br /> <br /> 1. Any tree with a circumference of forty (40) <br /> inches or more measured two and one-half feet <br /> above ground level. <br /> <br /> 2.Any tree thirty-five feet or more in height. <br /> <br /> 3. Any tree of particular historical significance <br /> specifically designated by official action. <br /> <br /> 4. A stand of trees the nature of which makes <br /> each dependent upon the others for survival. <br /> <br /> b. "Director" shall mean the City Manager or his <br /> <br /> designated representative. <br /> <br /> ~2-17.03 Exceptions. The provisions of this Chapter shall <br />not apply to fruit or, when part of an orchard, to nut bearing <br />trees the product of which is used for commercial purposes. <br /> <br /> Article 2 <br /> <br /> Permit Procedure <br /> <br /> ~2-17.05 Permit Required. No person shall cut down, de- <br />stroy or remove any heritage tree g~owing within the City limits <br />from any property without a permit except as provided herein. <br /> <br /> ~2_17.06 Permit Procedures. Any person desiring to cut <br /> <br />down, destroy or remove one or more heritage trees on any property <br />in the City of Pleasanton shall make application to the Director. <br />Said application shall contain the number, species, size and <br />location of trees to be cut down, destroyed or removed and a brief <br />statement of the reason for removal as well as any other pertinent <br />information he may require. The permit, if granted, shall entitle <br />the applicant to remove one or more designated trees existing on <br />the property involved. Prior to the issuance of such permit the <br />Director shall visit and inspect the property, the tree or trees <br />in question, and the surrounding area and shall ascertain the <br /> <br /> -2- <br /> <br /> <br />
