ATTACHMENT 3 <br />RESOLUTION NO. 15- <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />APPROVING THE AFFORDABLE HOUSING AGREEMENT BETWEEN THE CITY OF <br />PLEASANTON AND PONDEROSA HOMES II, Inc., AS FILED UNDER CASE NO. <br />PUD -99. <br />WHEREAS, Ponderosa Homes II, Inc. has made an application to the City for an <br />Affordable Housing Agreement arising from the construction of 19 single - family <br />residential homes located at 1851 Rose Avenue, as filed under Case No. PUD -99, and <br />Ponderosa proposes to utilize inclusionary unit credits from another Ponderosa project <br />as set forth in the agreement, and <br />WHEREAS, the Pleasanton Housing Commission reviewed and recommended <br />approval of the Affordable Housing Agreement at its meeting of February 18, 2016; and <br />WHEREAS, a duly- noticed public hearing was held by the City Council on April <br />19, 2106, at which time the public was given the opportunity to comment on the <br />Affordable Housing Agreement, and <br />WHEREAS, based on the Supplemental Environmental Impact Report (SEIR) <br />prepared for the Housing Element update in 2011, the project site was part of Housing <br />Element update; thus, the proposed development is substantially consistent with the <br />2011 Housing Element update, which was analyzed in the SEIR. No new information or <br />changed circumstances have occurred that would require supplemental environmental <br />review, pursuant to California Environmental Quality Act (CEQA) Guidelines Section <br />15162: and <br />WHEREAS, the City Council considered all the information presented at the <br />public hearing regarding the terms of the Affordable Housing Agreement. <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br />CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER <br />THE FOLLOWING: <br />SECTION 1. Finds that the proposed Affordable Housing Agreement between the <br />City of Pleasanton and Ponderosa Homes Il, Inc. is consistent with the City's General Plan <br />and the objectives of the City's affordable housing polices. <br />SECTION 2. Approves the Affordable Housing Agreement between the City of <br />Pleasanton and Ponderosa Homes II, Inc., a copy of which is attached hereto as Exhibit <br />A and incorporated herein by this reference; and authorizes the City Manager to <br />execute the Affordable Housing Agreement in generally the form attached as Exhibit A, <br />subject to approval by the City Attorney. <br />
