RESOLUTION NO. 16- <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />AUTHORIZING STAFF TO SUBMIT AN OUT -OF -AREA SERVICE AGREEMENT <br />APPLICATION TO LAFCO FOR PROPERTIES ALREADY CONNECTED TO CITY <br />SEWER AND /OR WATER UTILITIES <br />WHEREAS, effective 2001, California law has required that the City make an application <br />to the Alameda County Local Agency Formation Commission (LAFCo) for an Out -of -Area Service <br />Agreement (OASA) before connecting any property outside the city limits to city sewer and /or <br />water utilities; and <br />WHEREAS, when making an application for an OASA to LAFCo at their meeting on <br />September 11, 2014 for a property located in unincorporated Happy Valley, it was discovered that <br />many properties within the Happy Valley area have been connected to the City utilities without <br />the requisite OASA in place; and <br />WHEREAS, during the research of utility billing records to determine when the <br />connections were made, staff discovered many properties had connected post 2001, and that this <br />situation was not confined to the Happy Valley area, but also included properties in the Remen <br />Tract and in unincorporated areas west of Foothill Road; and <br />WHEREAS, City staff presented these findings to LAFCo staff, who in turn took the <br />information to the LAFCo Board on July 9, 2015; and <br />WHEREAS, the LAFCo Board directed their staff to work with City staff to retroactively <br />approve the connections made to date; and <br />WHEREAS, City staff, in working with LAFCo staff, has prepared the required application <br />materials to retroactively process the OASAs for the properties already connected; and <br />WHEREAS, the application requires that City Council adopt a resolution authorizing the <br />application be submitted to LAFCo; and <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: <br />SECTION 1: Staff is authorized to submit an Out -of -Area Service Agreement application <br />to LAFCo for properties already connected to City sewer and /or water utilities. <br />SECTION 2: The $10,500 LAFCo fee shall be covered through an allocation from the <br />General Fund Unallocated Reserve <br />SECTION 3: The City Clerk shall certify to the passage of this resolution and enter it into <br />the book of original resolutions. <br />SECTION 4: This resolution shall become effective immediately upon its passage and <br />adoption. <br />
