RESOLUTION NO. 16-833
<br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON
<br /> DECLARING THAT WEEDS, DIRT, RUBBISH, AND REFUSE UPON OR IN FRONT
<br /> OF CERTAIN DESCRIBED PROPERTIES WITHIN THE CITY OF PLEASANTON
<br /> CONSTITUTE PUBLIC NUISANCES AND THAT THEY BE ABATED, AND SETTING
<br /> A PUBLIC HEARING REGARDING THE ABATEMENT
<br /> WHEREAS, there is attached hereto and incorporated by reference herein as if fully set
<br /> forth a list of properties to which this resolution applies; and
<br /> WHEREAS, said list of properties specifically sets forth street, lot and block numbers
<br /> according to the official assessment map for each piece of property; and
<br /> WHEREAS, the properties list have, upon or in front of them, weeds, as defined by
<br /> Section 39561.5 of the Government Code, dirt, rubbish, or refuse; and
<br /> WHEREAS, after consideration of evidence, it appears that said weeds, dirt, rubbish,
<br /> and refuse are a public nuisance in that they constitute a fire hazard, or that said materials are
<br /> noxious or dangerous and as such, are detrimental to the health, safety and welfare of the City
<br /> of Pleasanton and, as such, shall be removed; and
<br /> WHEREAS, it appears that the public nuisances referred to herein are recurrent and
<br /> seasonal in nature.
<br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF
<br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING:
<br /> SECTION 1. That the weeds, dirt, rubbish and refuse upon on or in front of the
<br /> properties described in the list of attached hereto and incorporated by reference herein, are
<br /> declared a public nuisance and are to be abated and removed pursuant to the procedure
<br /> provided by Section 39560-39588 of the Government Code.
<br /> SECTION 2. A public hearing shall be held Tuesday, April 19, 2016 at 7:00 p.m. in the
<br /> City Council Chamber, 200 Old Bemal Avenue, Pleasanton at which time property owners
<br /> having objections to the proposed removal of weeds, rubbish, refuse and dirt will be heard and
<br /> given due consideration.
<br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at
<br /> a regular meeting held on March 1, 2016.
<br /> I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing
<br /> resolution was adopted by the City Council at a regular meeting held on the 1st day of March,
<br /> 2016 by the following vote:
<br /> Ayes: Councilmembers Brown, Narum, Olson, Mayor Thorne
<br /> Noes: None
<br /> Absent: Councilmember Pentin
