Box 520 <br /> Pleasanton, CA 94566 <br /> WHEN RECORDED MAIL TO: <br /> U.S. Department of Housing and <br /> Urban Development <br /> Attn: Office of Counsel <br /> 1 Sansome Street, 12th Floor <br /> San Francisco, CA 94104 <br /> Recording requested Pursuant to <br /> Government Code Sections <br /> No Fee-27383 <br /> RELEASE OF DECLARATION OF TRUST <br /> (KOTTINGER PLACE) <br /> This Release of Declaration of Trust (this "Release") is made as of the day of <br /> 1, 20_, by the United States of America, acting by and through the Secretary of <br /> the U.S. Department of Housing and Urban Development (herein, "HUD"), and the City of <br /> Pleasanton, a California municipal corporation (the "City"), with respect to that certain property <br /> located in the City of Pleasanton, Alameda County, State of California, more particularly <br /> described in Exhibit A, attached hereto and incorporated herein (referred to herein as the <br /> "Disposition Property"), such Disposition Property otherwise known as Kottinger Place, <br /> CA081000001. <br /> RECITALS <br /> WHEREAS, the Housing Authority of the City of Pleasanton, a public body corporate <br /> and politic, organized under the laws of the State of California ("PHA"), intends to transfer the <br /> Disposition Property via a negotiated sale at less than fair market value to the City of Pleasanton, <br /> a municipal corporation, organized under the laws of the State of California("Purchaser"); <br /> WHEREAS, PHA previously executed and recorded a document entitled "Declaration of <br /> Trust,"recorded on July 20, 1989 as Instrument Number 89-195324 in the official records of the <br /> County of Alameda (the "Declaration of Trust"), which granted to HUD certain rights and <br /> imposed certain restrictions with respect to the Disposition Property; <br /> WHEREAS, PHA previously requested HUD approval of the sale of the Disposition <br /> Property and HUD has, as documented in the letter from HUD to PHA dated February 26, 2015, <br /> as thereafter amended (as amended, the "Approval Letter"), agreed to such sale on the terms <br /> and conditions set forth in the Approval Letter and this Release; <br />
