THE CITY OF °� <br /> =i t_ '}Lr,—m a y": •_ , �.a I/ <br /> L�EASANTONC CITY COUNCIL AGENDA REPORT <br /> February 16, 2016 <br /> Community Development <br /> Building and Safety Division <br /> TITLE: ADOPT A RESOLUTION AUTHORIZING THE REFUND OF PERMIT AND <br /> DEVELOPMENT FEES FOR THE HANA JAPAN PROJECT AT 11991 <br /> DUBLIN CANYON ROAD, ON-SITE PERMIT B12-0235 AND BUILDING <br /> PERMIT B12-0307 <br /> SUMMARY <br /> Jong-ki Yoon has requested a refund of the Building and Development Fees that were <br /> paid by the Hana Yoon Corporation for the On-Site permit (B12-0235) and New <br /> Commercial Building permit(B12-0307) associated with their new Hana Japan restaurant <br /> project at 11991 Dublin Canyon Road. The fees were paid at the time of permit issuance, <br /> however the project did not move forward and was never built. The permit and the <br /> prescribed period to request a refund through administrative approval have expired. <br /> STAFF RECOMMENDATION <br /> Staff recommends that the City Council adopt a resolution authorizing the refund to the <br /> Hana Yoon Corporation of $121,322.69 of the $191,854.80 that was paid in building <br /> permit and development fees. <br /> FINANCIAL STATEMENT <br /> As a result of the project not being constructed, the City did not have to mitigate <br /> development impacts or complete inspections. Retaining 20 percent of the permit fees <br /> is consistent with other refund procedures in the Pleasanton Municipal Code and will <br /> cover the administrative costs that were incurred while the project was under review. <br />
