identified archaeological materials and fossils, and the preparation of a construction <br /> traffic management plan. <br /> The specific details of the mitigation for the undergrounding of the drainage swale will <br /> be subject to the review and approval of U.S. Army Corps of Engineers, the California <br /> Department of Fish and Wildlife, and the Regional Water Quality Control Board as part <br /> of the permitting application for the project, but the mitigation measure in the IS/MND <br /> specifies the following options requiring off-site habitat compensation at a minimum 1:1 <br /> replacement ratio: <br /> 1) Purchase of wetland credits at an approved wetland mitigation bank; <br /> 2) Payment of in-lieu fees to an agency-approved land bank of a conservation entity <br /> to acquire and protect existing wetlands; <br /> 3) Payment towards specific public or private wetland habitat, creation, restoration, <br /> or enhancement projects; <br /> 4) Undertaking a habitat creation project within the City; or <br /> 5) Using existing mitigation credits owned by the City. <br /> During the 30-day public and agency review period for the Draft IS/MND, the City <br /> received comments from four entities: the Governor's Office of Planning and Research, <br /> State Clearinghouse; the California Department of Fish and Wildlife; the Regional Water <br /> Quality Control Board; and Debra Donald, a Pleasanton resident. Detailed responses to <br /> all comments received were provided in the Final IS/MND, along with a Mitigation <br /> Monitoring and Reporting Program that identifies responsibility for ensuring the success <br /> of each identified mitigation measure. Minor corrections and clarifications were <br /> incorporated into the Draft IS/MND as part of the response to comments process (see <br /> Attachment 3 for the Final IS/MND, including responses to comments, Mitigation <br /> Monitoring and Reporting Program, and minor revisions to the Draft IS/MND). <br /> The State Clearinghouse's comments related to confirmation of receipt of the Draft <br /> IS/MND. Debra Donald's comments related to construction-period disruptions to <br /> neighborhood residents and the desire to minimize these disruptions. The most <br /> technical comments were submitted by the California Department of Fish and Wildlife <br /> and the Regional Water Quality Control Board. These comments, and the responses <br /> provided in the Final IS/MND, are summarized below: <br /> • Disagreement about the characterization of riparian habitat around the segment <br /> of Kottinger Creek that would be undergrounded. As documented in the Draft <br /> IS/MND and Biological Assessment (submitted as part of the permitting <br /> package), the subject segment of Kottinger Creek only carries water during and <br /> after periods of considerable rainfall (due to success with upstream, stormwater <br /> retention), the banks have no vegetation, and the only vegetation near the banks <br /> consists of grassy areas and planted trees with limited habitat value.
