CITY COUNCIL AGENDA REPORT February 16, 2016 City Manager TITLE: A RESOLUTION OF THE CITY OF PLEASANTON OPTING IN TO PHASE 2 OF THE MANDATORY RECYCLING ORDINANCE REQUIRING COMMERCIAL RECYLING AND ORGANICS COLLECTION SUBJECT TO THE APPROVAL OF A COMPLIANCE SCHEDULE WAIVER SUMMARY In December of 2013 the City of Pleasanton elected to opt out of Phase 2 of the Mandatory Recycling Ordinance. Phase 2 requires provision of recycling services for all commercial accounts and provision of service for the collection of organics (food scraps and food-soiled paper) to all commercial accounts that generate a significant quantity of food scraps. Phase 2 also requires organics recycling for every multi-family building with five or more housing units. The ordinance allows for cities to "opt-in" to Phase 2 of the program to the approval of a Schedule Compliance Waiver which stipulates a date by which a Phase 2 compliant program will be in place. City staff, the City Council Sub-committee on Refuse and Recycling, and the City Council have all discussed the growing interest and need for implementation of a commercial organics recycling program. Such a program would also allow restoration of Measure D funding. RECOMMENDATION Approve the attached resolution (Attachment 1) opting in to Phase 2 of the Mandatory Recycling Ordinance. FINANCIAL STATEMENT Opting in to Phase 2 of the ordinance will likely increase costs to both the City and the ratepayers. The amount of these costs will be determined and considered by the City Council in advance of the proposed program start date of January 1, 2017.
