necessary to allow the Existing Public Housing Households who desire PBV Units to receive <br /> them. <br /> 4. Relocation of Existing Public Housing Tenants. <br /> A. Interim Period. Following the recordation of the Use Agreement and <br /> HUD's release of the Declaration of Trust, the Owner will provide the Existing Public Housing <br /> Households the right to remain in their Existing Units until such time that the Owner enters into <br /> a Ground Lease(the"Ground Lease")with Kottinger Gardens Phase 1 Associates, L.P. (the <br /> "Lessee"). Once a memorandum of the Ground Lease is recorded, the Lessee will be responsible <br /> for moving the Existing Public Housing Households off-site to temporary housing where they <br /> will reside during construction of the New Units. The rent due from the Existing Public Housing <br /> Households after HUD releases its Declaration of Trust until they move off-site will be restricted <br /> to the amount of rent that would be due if the Existing Units were still being operated as public <br /> housing. <br /> B. Temporary Housing Units. The Lessee will provide the Existing Public <br /> Housing Households with comparable temporary housing until such time that the PBV Units are <br /> constructed and ready for occupancy, which is projected to be less than twelve (12) months. The <br /> rent due from the Existing Public Housing Households for the temporary housing will be <br /> restricted to the amount of rent that would be due from the Existing Public Housing Households <br /> if they were still residing in the Existing Units and the Existing Units were being operated as <br /> public housing. Any rental amounts exceeding the Existing Public Housing Households' portion <br /> of the rent will be paid by the Lessee. <br /> C. Moving Expenses. The Lessee will pay for all of the Existing Public <br /> Housing Households' moving expenses associated with their moves from the Existing Units to <br /> the temporary housing and from the temporary housing to the PBV Units. The Owner will pay <br /> for the moving expenses associated with their moves from the temporary housing to permanent <br /> replacement housing if the PBV Units are not constructed as planned. <br /> D. Delivery of Housing Choice Vouchers to Public Housing Tenants. HACA <br /> will provide the Existing Public Housing Households with a Section 8 Housing Choice Voucher, <br /> provided to HACA by HUD as replacement housing vouchers and not from HACA's existing <br /> voucher allocation, if the Existing Public Housing Households are not able to move into the PBV <br /> Units by July 1, 2017. The Owner shall use its best efforts to assist the Existing Public Housing <br /> Households to use the Section 8 Housing Choice Vouchers provided to them to find permanent <br /> replacement housing. <br /> 5. Title Insurance. Within ten (10) business days of recordation of the Use <br /> Agreement, PHA and/or Owner shall provide HUD with a conformed copy of a lender's and/or <br /> Owner's title insurance policy, evidencing that the Use Agreement has been recorded prior to <br /> any liens or encumbrances, excepting those items specifically excluded in paragraph 2.(i) <br /> through (iii) inclusive, above. <br /> 6.
