RESOLUTION NO. 16-819 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> ADOPTING THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) FINDINGS <br /> AND THE MITIGATION MONITORING AND REPORTING PROGRAM FOR THE <br /> LUND RANCH II DEVELOPMENT, AS FILED UNDER CASE PUD-25 <br /> WHEREAS, the City of Pleasanton, acting as lead agency under the California <br /> Environmental Quality Act (CEQA), prepared a Draft Environmental Impact Report for the Lund <br /> Ranch II project which was published in July 2014 and provided proper legal notice of document <br /> preparation and availability; and <br /> WHEREAS, the Planning Commission held a noticed public hearing on August 27, 2014 to <br /> accept oral and written comments on the Draft Environmental Impact Report during the forty-five- <br /> day public review period, and the City also accepted and responded to written comments to the <br /> Draft Environmental Impact Report received from public agencies having jurisdiction by law, <br /> persons having special expertise with respect to any environmental impact involved, and other <br /> persons or organizations having an interest in the proposed project; and <br /> WHEREAS, the Final Environmental Impact Report has been prepared and contains the <br /> Draft Environmental Impact Report, comments and recommendations received on the Draft <br /> Environmental Impact Report, and the responses of the City of Pleasanton to comments raised <br /> regarding environmental issues in the review and consultation process; and <br /> WHEREAS, the City provided proper notice of completion of the Final Environmental <br /> Impact Report; and <br /> WHEREAS, on December 1, 2015, the City Council certified the Final Environmental <br /> Impact Report for the project as adequate and complete and adopted CEQA Findings and <br /> Mitigation Monitoring and Reporting Program for the project. <br /> WHEREAS, on December 15, 2015, the City Council proposed modifying the Project to <br /> reduce the number of units from 48 to 43 units and lowered the maximum elevation of the <br /> building pad for Lot 32. The City Council also proposed that 12 lots would connect to Lund <br /> Ranch Road and 31 lots would connect to Sunset Creek Lane. <br /> WHEREAS, these proposed project modifications will not result in any new or <br /> substantially increased impacts and there is no significant new information available since <br /> December 1, 2015 that would require preparation of a Subsequent EIR under CEQA Section <br /> 21166. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. The City Council re-adopts the CEQA Findings and Mitigation Monitoring <br /> and Reporting Program for the project as modified and attached hereto as Exhibit A. <br /> SECTION 2. This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> 1 <br />
