ORDINANCE NO. 2135 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />APPROVING THE APPLICATION OF FIRESIDE INVESTORS, LLC FOR PLANNED <br />UNIT DEVELOPMENT (PUD) REZONING AND DEVELOPMENT PLAN APPROVAL, <br />AS FILED UNDER CASE PUD -107 <br />WHEREAS, Fireside Investors, LLC has applied for Planned Unit Development (PUD) <br />rezoning of the approximately 0.25 -acre property located at 377 St. Mary Street from the C -C <br />(Central Commercial), Downtown Revitalization, Core Area Overlay District to a PUD- HDR/C -C, <br />Downtown Revitalization, Core Area Overlay District, and for PUD Development Plan approval <br />to convert the existing single - family residence into a commercial use building including site and <br />exterior building modifications, and to construct three detached single - family residences ( "the <br />Project"); and <br />WHEREAS, at its public hearing on November 18, 2015, the Planning Commission <br />adopted Resolution No.PC- 2015 -39, determining that the proposed rezoning and Development <br />Plan are appropriate for the site, making findings, and recommending to the City Council that <br />PUD -107 be approved; and <br />WHEREAS, on December 15, 2015, the City Council held a duly noticed public hearing <br />on the application and considered all public testimony, agenda report, and related materials, <br />and the recommendations of City staff and the Planning Commission; and <br />WHEREAS, the City Council finds that the proposed PUD rezoning and Development <br />Plan are consistent with the City's General Plan and purposes of the PUD Ordinance. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />DOESHEREBY ORDAIN AS FOLLOWS: <br />SECTION 1. It approves the rezoning of the approximately 0.25 -acre property located <br />at 377 St. Mary Street from the C -C (Central Commercial), Downtown Revitalization, Core Area <br />Overlay District to a PUD- HDR/C -C, Downtown Revitalization, Core Area Overlay District. <br />SECTION 2. The Zoning Map of the City of Pleasanton, dated April 18, 1960, on file <br />with the City Clerk, designating and dividing the City into zoning districts, is hereby amended by <br />Zoning Unit Map No. 496, attached hereto as Exhibit B, dated December 15, 2015 and <br />incorporated herein by this reference. <br />SECTION 3. The Council approves Case PUD -107, the application of Fireside <br />Investors, LLC for Planned Unit Development (PUD) Development Plan to convert the existing <br />single - family residence into a commercial use building including site and exterior building <br />modifications, and to construct three detached single - family residences located at 377 St. Mary <br />Street, subject to the conditions as shown in Exhibit A, attached hereto and made part of this <br />ordinance by this reference. <br />SECTION 4. A summary of this ordinance shall be published once within fifteen (15) <br />days after its adoption in the "Valley Times," a newspaper of general circulation published in the <br />City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City <br />Clerk's Office within fifteen (15) days of its adoption. <br />
