EXHIBIT A <br /> Draft Conditions of Approval <br /> PUD-107, 377 St. Mary Street <br /> December 15, 2015 <br /> PROJECT SPECIFIC CONDITIONS OF APPROVAL <br /> Planning Division <br /> 1. The proposed Planned Unit Development Rezoning and Development Plan shall <br /> conform substantially to the project narrative, plans, color palette, and arborist report, <br /> Exhibit B, dated "Received October 5, 2015," on file with the Planning Division, except <br /> as modified by the following conditions of approval. Minor changes to the plans may be <br /> allowed subject to the approval of the Director of Community Development if found to be <br /> in substantial conformance to the approved exhibits. <br /> 2. The Planned Unit Development Development Plan shall lapse two years from the <br /> effective date of approval unless a building permit is obtained and construction diligently <br /> pursued, or a parcel map is recorded, or the City has approved a time extension. <br /> 3. The permitted and conditionally permitted uses for the Planned Unit Development — <br /> High Density Residential (PUD-HDR) zoned portion of the subject property shall be <br /> those of the R-1 One-Family Residential District. <br /> 4. Unless otherwise specified in the conditions of approval, the accessory structure site <br /> development standards shall be those of the RM-2,500 District. <br /> 5. No additions or expansions are permitted to any house or garage within the project <br /> area. Future building and/or site improvements not covered by this development plan <br /> approval will be subject to City review and approval prior to any changes to the building <br /> and/or site. <br /> 6. The garages shall not be modified or used for storage in a manner that would interfere <br /> with the ability to park two cars within the garage and each resident shall utilize the <br /> garages for the parking of vehicles. In addition, boats, trailers, campers, motor homes, <br /> and other recreational vehicles shall not be parked or stored on-site. <br /> 7. The permitted uses for the Planned Unit Development— Central Commercial (PUD-C-C) <br /> zoned portion of the subject property shall include: <br /> Special downtown accessory entertainment P <br /> uses, as defined in Chapter 18.08 of this title: <br /> a. Indoor special downtown accessory entertainment uses with non-amplified or amplified sound in <br /> the downtown hospitality central core area and non-amplified sound in the downtown hospitality <br /> transition area(hours: 8:00 a.m.-11:00 p.m.) <br /> b. Indoor special downtown accessory entertainment uses with amplified sound in the downtown <br /> hospitality transition area (hours: 8:00 a.m.-9:00 p.m.) <br /> c. Outdoor special downtown accessory entertainment uses(hours: 8:00 a.m.-9:00 p.m.) <br />
