THE CITY OF _ <br /> L��Sfo CITY COUNCIL AGENDA REPORT <br /> NTON. <br /> January 19, 2016 <br /> City Attorney <br /> TITLE: ADOPT AN URGENCY ORDINANCE TO AMEND MUNICIPAL CODE <br /> CHAPTER 6.18 TO PROHIBIT COMMERCIAL CULTIVATION AND <br /> COMMERCIAL DELIVERY OF MEDICAL MARIJUANA IN RESPONSE TO <br /> NEW STATE LAWS <br /> SUMMARY <br /> California voters de-criminalized medical marijuana in 1996, and the California <br /> legislature subsequently adopted various identification card and other regulations. In <br /> 2007 the City adopted a prohibition on medical marijuana dispensaries due to concerns <br /> about crime, public health and safety. The State legislature has adopted new laws <br /> which would allow for the commercial delivery, cultivation and State licensing of medical <br /> marijuana operations. If the City does not take action to regulate or prohibit such <br /> expanded medical marijuana activities, the State will become the sole regulatory <br /> authority. The proposed urgency ordinance would prohibit commercial cultivation and <br /> commercial delivery of medical marijuana, while acknowledging the rights of qualified <br /> patients and their primary caregivers by allowing indoor cultivation of three plants per <br /> patient, in order to preserve local control and protect the public health, safety and <br /> welfare. <br /> RECOMMENDATION <br /> Adopt the attached urgency ordinance amending Municipal Code Chapter 6.18 (Medical <br /> Marijuana Dispensaries). An urgency ordinance requires a 415th vote. <br /> FINANCIAL STATEMENT <br /> No financial impact. <br />
