35. The project applicant or developer and/or the project applicant's or developer's <br /> contractor(s) shall obtain an encroachment permit from the City Engineer prior to <br /> moving any construction equipment onto the site. <br /> Landscaping Requirements <br /> 36. The project applicant or developer shall enter into an agreement with the City, <br /> approved by the City Attorney, which guarantees that all landscaping and open <br /> space areas included in this project will be maintained at all times in a manner <br /> consistent with the approved landscape plan for this development. Said <br /> agreement shall run with the land for the duration of the existence of the <br /> structures located on the subject property. <br /> Climate Action Plan <br /> 37. In accordance with Climate Action Plan (CAP) Measure LU3-2, the project shall <br /> provide building, landscape, and streetscape development features that <br /> encourage bicycle and pedestrian access, to the satisfaction of the Director of <br /> Community Development. <br /> 38. In accordance with CAP Measure LU3-5, all streets within the project site shall <br /> be designed to Complete Streets standards except for the connection to Sunset <br /> Creek Lane. <br /> 39. In accordance with CAP Measure NM1-13, the applicant shall install the trail <br /> system within the project site that is identified in the Pedestrian and Bicycle <br /> Master Plan. <br /> 40. In accordance with CAP Measure EC1-3, light-colored paving materials shall be <br /> used on all streets within the project site. <br /> 41. In accordance with CAP Measure EC4-4, the plans for residential units shall <br /> incorporate solar tubes, skylights, and/or other daylighting systems within the <br /> building design. These systems shall be identified on plans submitted to the <br /> Building and Safety Division for permits. <br /> 42. In accordance with CAP Measure WA-3-4, the project shall incorporate rain <br /> harvesting. Acceptable methods to achieve this measure include directing roof <br /> leaders into landscaping areas, and providing containers that can hold recycled <br /> water for irrigation purposes in lieu of using potable water. <br /> Page 8 of 31 <br />
