ATTACHMENT 3 <br /> RESOLUTION NO. 15- <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> ADOPTING THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) <br /> FINDINGS AND THE MITIGATION MONITORING AND REPORTING <br /> PROGRAM FOR THE LUND RANCH II DEVELOPMENT, AS FILED UNDER <br /> CASE PUD-25 <br /> WHEREAS, the City of Pleasanton, acting as lead agency under the California <br /> Environmental Quality Act (CEQA), prepared a Draft Environmental Impact Report for the <br /> Lund Ranch II project which was published in July 2014 and provided proper legal notice <br /> of document preparation and availability; and <br /> WHEREAS, the Planning Commission held a noticed public hearing on August 27, <br /> 2014 to accept oral and written comments on the Draft Environmental Impact Report <br /> during the forty-five-day public review period, and the City also accepted and responded to <br /> written comments to the Draft Environmental Impact Report received from public agencies <br /> having jurisdiction by law, persons having special expertise with respect to any <br /> environmental impact involved, and other persons or organizations having an interest in <br /> the proposed project; and <br /> WHEREAS, the Final Environmental Impact Report has been prepared and <br /> contains the Draft Environmental Impact Report, comments and recommendations <br /> received on the Draft Environmental Impact Report, and the responses of the City of <br /> Pleasanton to comments raised regarding environmental issues in the review and <br /> consultation process; and <br /> WHEREAS, the City provided proper notice of completion of the Final <br /> Environmental Impact Report; and <br /> WHEREAS, on December 1, 2015, the City Council certified the Final <br /> Environmental Impact Report for the project as adequate and complete and adopted <br /> CEQA Findings and Mitigation Monitoring and Reporting Program for the project. <br /> WHEREAS, on December 15, 2015, the City Council proposed modifying the <br /> Project to reduce the number of units from 48 to 43 units and lowered the maximum <br /> elevation of the building pad for Lot 32. The City Council also proposed that 12 lots <br /> would connect to Lund Ranch Road and 31 lots would connect to Sunset Creek Lane. <br /> WHEREAS, these proposed project modifications will not result in any new or <br /> substantially increased impacts and there is no significant new information available <br /> since December 1, 2015 that would require preparation of a Subsequent EIR under <br /> CEQA Section 21166. <br /> 1 <br />
