Bill Lincoln stated forwarded a copy of a letter received from Sycamore Heights Homeowners Association attorney to all parties involved in the Lund Ranch II development for review. The letter was in response to a question posed regarding the possible partial use of open space for access to the Lund Ranch II project and noted that would better comply with the intent of Measure PP. He also stated if there is an interest in his proposal the council should delay making a decision for 60 to 90 days in order to have enough time for board meetings and further analysis. Mr. Lincoln indicated he was willing to approach the Homeowners Association Board of Directors if there was such an interest. Mathew Nelson commented on the traffic flow and stated that the maps being shown regarding the proposal don't indicate where the full access roads are located and therefore councilmembers have a tainted view of what they are looking at. Allen Roberts commented on the proposed new plan and the amount of time both councilmembers and the public had to evaluate the new plan and believes that it is wrong. He noted that there was not enough time for the proposed plan to be reviewed by the public or councilmembers. He also stated that since it is up to the councilmembers to evaluate and interpret the new terms of Measure PP their interpretation of Measure PP needs to be held to subsequent projects. Andy Burstein stated that the purpose of Measure PP was to protect the hillsides and gave several analogies of what Measure PP stands for. He concluded by asking the Council not to build so many homes if they are concerned about traffic. Kay Ayala stated that the new plan of 19 homes heading out of Lund Ranch Road and 28 heading out of Sunset Creek is incorrect. The correct number is 34 homes heading out of Lund Ranch Road due to the fact that Middleton was supposed to head the opposite direction. Ms. Ayala requested the councilmembers to think of the 15 homes heading out of Middleton when considering the new proposed plan. Christian Cebrian the attorney representing Greenbriar Homes stated that CEQA allows a lead agency to modify a proposal but it doesn't require endless review. The change in the figure shows is the relocation of the second roadway and proposed a barricade at the 19/29 split which were previously discussed. Mr. Cebrian stated that Mr. Flashman raised three issues regarding CEQA. These issues are stormwater, soil stability and bicycle safety. He said the he existing mitigation measures in the FEIR address the potential stormwater and soil stability issues, and furthermore, the project would have to comply with several permitting processes spelled out in the EIR. Ms. Ramirez-Holmes reiterated that the project will contain no walls except at the culvert. And that staff determination indicated the ridge was at 580 feet and the ridgeline doesn't cross the creek it would stop at the creek. Open space parking will be accessed by Sunset Creek. The same three options which were available to council at last meeting are still available with option three being the split of 10/40 or some number. Ms. Ramirez-Holmes noted option three allowed Council to set that number. Mayor Thorne closed the public hearing. Councilmember Brown wanted clarification from City Attorney Lowell if it was prudent to have a council re-interpret Measure PP when a previous council had voted on the terminology three years ago to which Mr. Lowell replied that although an ordinance interpreting Measure PP was introduced by a first reading in 2013, there was never a second reading done to adopt and approve the ordinance. Mr. Lowell noted actions taken by this Council regarding Measure PP if finally adopted, would be persuasive to a Court where litigation were to occur.
